It seems you'd be using a sledgehammer to crack a nut by taking them to court.
I am still looking for the complaint where atleast one person claimed that he/she had only ever returned one item. Perhaps I am mistaken, but don't think so. Definitely recall reading about it. Will keep looking and keep you posted here.

Besides, were I to accept a repair action, I would forever forfeit my right to a refund and forevermore have to accept a repair action.
You really do need to brush up on your consumer rights.

After one failed repair, you can then reject the goods for a refund.
You do not have to accept a second repair.

Section 24 of The Consumer Rights Act refers.

Thanks. I have every right to reject the goods.
No you don't - you only get that in the first 30 days. The seller could choose to repair or replace if he wishes.

All this hassle when you could solve the problem for £6.

The seller has done neither. He was given all the information he asked for and based on that he diagnosed the problem, then blamed me for it, informed me that out of goodwill, he will contact the manufacturer. That was several days after I reported the problem stressing the seat was unsafe. The merchant has simply blamed me, rejected a cost effective solution and merely offered to contact the manufacturer.

6 quid is 6 quid. Why should the merchant not do what he/she is supposed to do? It is not the 6 quid. The principle of doing business. If anyone, it is the merchant who has cut his nose off. He could have agreed to supply the metal hinge and sent the bill to the manufacturer together with the failed hinge so the manufacturer could investigate the failure and redesign the failed component. You can be sure that if there is one failed hinge, there will be others. A responsible manufacturer would be grateful for the return of failed components for analysis.

Thank you. Please can someone clarify who is responsible to effect the repair? I shall be quite happy not to do it myself and get the merchant to come over, from Southshields to Surbiton or send a repairman.

You do realise that if this did go to a hearing, the merchant could request it be held in South Shields?
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

Thanks. I will go to the end of the earth to have my day in court for this problem.

Some would say (not me) South Shields is the end of the world!
