  • When should I contact the court to see if the claimants have filed their WS and paid the court hearing fee.


    In regards to the cost schedule, should I claim for exemplary damages in person to the judge or should I put this on the cost schedule?

    There is a fairly obvious answer - after the deadline for each one has passed.

    How are you claiming for damages? That would require a counterclaim, to my understanding
    In a cost schedule you claim for
    - standard, ordinary costs . Attending hearing loss of leave or pay, half a day, capped at £95. Parking, mileage

    ENTIRELY DIFFERENT SECTION, with its OWN HEADING, for unreasonable behaviour costs
    Ref the CPR that allows them
    List in bullet form the claimants unreasonable behaviour
    Then itemise your costs - time taken to research Defence at £19 per hour, time spent writing defence at £19 per hour...etc.

    Funny that as my court date is a few days away.

  • First and foremost, I would like to say a massive thank you to you all for your help!


    I won the case!!!! :)


    The judge dismissed the case within 15mins. The judge was on my side and could not believe they had wasted everyone's time as I had clearly provided evidence of having paid for a ticket.
    The judge went on to say that they shouldn't have accepted the payment if I hadn't followed the terms and conditions. If anything they should have given me the money back....not ask for more money.


    I could not believe at how unprepared CEL were. She kept on rambling on about how did not follow the terms and conditions, but there was no evidence as to how I did. The Judge had to shut her down on many occasions as she wasn't making any sense.


    The Judge awarded me £169.90 :)


    I am so relieved that this is over but I have learnt a great deal. If I could take you all out for a drink...I would.


    Thanks again for all of your help, patience and giving me the confidence to not give in to these criminals.

    Maybe CEL will go back to discontinuing, rather than having ajudgement against them like that.

    Can you give us the judges name and the claim number? It helps others if they can talk about the issues.

    A rare court appearance by CEL, but they were stuffed and for costs too! :T
