Thanks @KeithP
I have made the change.
Is there anything else that I need to send with this ie counter-claim ?0 -
Just to confirm, I can email my WS to ccbcaq@hmcts.gsi.gov.uk and then post a physical copy to the claimant?0

Your case has been transferred to your local court hasn't it?
Not sure how long you WS and evidence bundle is, but the usual advice is to hand deliver a nicely presented bundle to the court.
Email to the claimant if you like.0 -

definitely not, they bowed out when it was transferred to your local court
do as KeithP says above0 -
Ok thank you!
Will hand deliver it , I will post my WS to the claimant.
In regards to the counter claim, is this something I need to have ready in court or is this something I should attach to my WS?0 -

when you did the defence, did you fill in a counter claim form and pay the £25 fee they require ?
if not , then you do not have any counter claim !!
I do not believe you have done this so no you cannot issue a counter claim now (AFAIK)
I suspect you mean your costs schedule for a costs order , not a counter claim
costs schedules and orders are discussed by LOC123 and maybe others in the NEWBIES FAQ sticky thread
at the WS stage , you would give the WS in to the local county court and the claimant , plus any evidence you are relying on, then the costs schedule for a costs order needs to be submitted a few days before the court date (I suspect you mean this costs schedule - not counter claim)
if you have done a counter claim along with the defence many moons ago , then I apologise0 -
@Redx You're right, I meant the cost order. Will have a read through the NEWBIES thread.
Just had a quick read through where LOC123 mentions that costs order must be served at least 24 hours before the hearing. Again, is this to be hand delivered to the court only? or does a copy of this have to be sent to the claimant? I couldn't see any information on this.0 -
deffo to the court (at least 24 hours before , hence why I said a few days before , not sure about the claimant (maybe email the claimant anyway, just in case)
its important at this stage to get your facts right , not to use terms that do not apply
its also important to realise that once the case was transferred to your local court, the government office in Northampton have done their part
making silly mistakes at this stage may prove costly , hence why we keep telling people to read that NEWBIES FAQ thread again , and again, and again0 -
You're talking about a costs schedule, which you need to prepare and file and serve if you want to ask the court to make a costs order.
The schedule needs to be prepared, filed at court and served on the C at least 24 hours prior.
In your Skeleton, if you are doing one, then at the end include a section about the costs application and what you reasons are. If you're too late and already done your skeleton, do a separate one for the costs arguments. Skeletons help everyone, you and the judge, to understand the arguments, they help you present your case and keep you calm in court.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. Thank you all so much for your advice. I'm feeling a little bit more confident.
@Redx Definitely going to continue doing a lot more research before the day.0
