  • @LOADSOFCHILDREN123 will definitely include a section about costs.
  • Hi all,

I have now hand delivered my WS to the court and put one in the post to the claimants.

Thanks again for your help and will keep you updated.

In your Skeleton, if you are doing one, then at the end include a section about the costs application and what you reasons are. If you're too late and already done your skeleton, do a separate one for the costs arguments. Skeletons help everyone, you and the judge, to understand the arguments, they help you present your case and keep you calm in court.

If you are considering this, by all means prepare one but wait for a week. If CEL are going to drop out it will be 7 days before the hearing when they dodge liability for costs.

  • @IamEmanresu thank you, I shall do that.
  • I'd do the skeleton 3 days before the hearing, so that would give you a few days after the 7 days starts!
Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. I accept no liability for the accuracy of any such posts and users are advised that, if they wish to obtain formal legal advice specific to their case, they must seek instruct and pay a solicitor.
  • I've just received their witness statement along with a final setttlment figure of £100 if paid within the next 7 days.

One of their points state that I do not recollect parking in the car park. Not once have I said that-why would they put this in their statement?

Last gasp attempt to grab anything before discontinuation?

You don't believe they are dealing specifically, individually and diligently with your case? At best they've copied and pasted incorrectly, at worst they've just sloppily used some kind of (part) template.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • They truly are criminals. Will be interesting to see if they actually follow through to the end.

I would ensure you note that lie and present it to the court. SHows how unreliable their claim is.
Their WS is clearly no such thing
  • Thank you, I definitely will!
