PIP Refused...Is MR Worth It ?

Neil, She advised me to definitely go ahead with the MR pointing out that I have nothing to lose, she did say that not many decisions are overturned at the MR stage, and advised me to send my letter off ASAP because of the time limit.....this I am doing in the morning.....Jack.Retired (Early) April 20150

Is this the case? Can you cook a simple meal by yourself? The CAB website has a suggestion of what a simple meal is.
I think you have had an excellent advice from Alice Holt and pmlindyloo earlier in this thread to be honest0 -
Unfortunately I answered no to q3a and q3b....I wrongly assumed that this was a mental agility question....in my head I can do this, physically I cannot....a classic case for getting help with the original claim form......It was the HCP at the assessment that noted that I needed an aid to carry out this task, in reality I would struggle to carry it out at all.....is it now too late to explain this? or will the DWP see it as merely point scoring ?.....I have no real evidence to support this issue, it is just how it is on a daily basis.......Jack.
Answering 'no' to both questions 3a and 3b would have given you 0 points for the Preparing Food activity, but the HCP listened to what you were saying and realised that you had given the wrong answer to question 3a and awarded 2 points.
Nevertheless, to get more points you need to be able to show that you at least need "supervision or assistance to either prepare or cook a simple meal". (That's descriptor 1(e).)
It comes down to a question of, how do you feed yourself? Do you rely on someone to come around every day to prepare your meals? If you are actually able to prepare your own meals with the use of and aid of or appliance (because that's what you do) then I don't think it matters how difficult that is. There are no additional points available for pain or inconvenience, or indeed for having "to sit with my right leg elevated, because of numbness and pain".
That might be regarded as unfair, but that's how PIP works.0 -

O.k. That's the letter ready to post in the morning, I asked the lady at CAB if I needed to send it by registered mail, she seemed to think that using "proof of postage" was o.k.....just one question, will DWP notify me when they receive it ? or is it best to ring them a couple of days after posting it ?....sorry that's two questions....anyway once it has gone off to them, and hopefully have heard from them, I can then forget about it for a while....oh, I did manage to use one of those document writer thingies, as my writing is quite hard to read...I am told that an MR can take months rather than weeks....we will see......Jack.Retired (Early) April 20150

My experience with the DWP tells me that I will be waiting years not weeks for a reply if ever!!.
Ironically and this is another unfair point, We have 30 days to send in the PIP claim form, 30 days in which to lodge a MR and 30 days to lodge an appeal. Yet the DWP refused to be drawn into accepting that they have to abide by any time limit when dealing with your claim or MR. They even put two fingers up to the Tribunal when directions given by the Judge that the DWP have 28 days to supply further information/evidence. The DWP do it in their own time and don't even recognise that time frame.0 -

Surely the best advice is to be totally honest with your answers that you put on the PIP2 and let the Assessor/DWP decide what descriptors you fit and what points should be awarded.
It seems to me that the general advice is to complete the PIP2 using the descriptors as a guide instead of explaining the actual situation that each person finds themselves in.
I didn't even write anything on my PIP2 nor did I read what had been put there, but I do suspect that what was written down for me mirrored my particular circumstances without any regard as to what the descriptors say.0
