Still I thought they would of took some responsibility over taking near a junction ( the car who allowed me to turn)
I think he was an accident waiting to happen and unfortunately I'm the person the accident was with. Just my opinion.0 -
I'm going try that tonight thank you. Only thing is that I've been told they will want to know the cost of the claim, I don't know this yet as its on going. I didn't protect my no claims no unfortunately. I will in future though.
You can put in guess - say £5000 , make sure you use dummy details so that you are anonymous online.
Your ncd will go down 2 years (none awarded for the current year), usually from a maximum of 5 years0 -
Is this the Highway Code rule you were thinking of?:
Rule 167
DO NOT overtake where you might come into conflict with other road users. For example- approaching or at a road junction on either side of the road
- where the road narrows
- when approaching a school crossing patrol
- between the kerb and a bus or tram when it is at a stop
- where traffic is queuing at junctions or road works
- when you would force another road user to swerve or slow down
- at a level crossing
- when a road user is indicating right, even if you believe the signal should have been cancelled. Do not take a risk; wait for the signal to be cancelled
- stay behind if you are following a cyclist approaching a roundabout or junction, and you intend to turn left
- when a tram is standing at a kerbside tram stop and there is no clearly marked passing lane for other traffic.

I will have to take there decision how it is absolutely gutted as I thought it said in the Highway Code about overtaking near a junction or at.
My complaint with my insurance is with there decision. Had he of waited for the car in front of him I wouldn't be in this situation
Only good thing is no one is seriously injured. It could of been a lot worse. Thankfully it was not.
Well if the car was indicating left then came to a stop the biker may have thought the car was just stopping on the side of the road so he overtook the stopped car.
You admit you didn't see the biker (which you should have) and he should have really been more aware when he over took. But at the end of the day you are in wrong because you cut infront of him when turning right.0 -
Yes it was. Have I any chance of his insurance taking some liability ? My insurance said they are going get them claim some but I guess nothing to lose if they try better then being 100% liable. Or am I just clutching at straws again
I have sorry did have 6 years no claims will the amount depending how many I lose? I am going call tomorrow as I'm new to all this
Many thanks for the replies. I was concentrating on the vehicle that let me go as I did not expect a motorbike over take as I thought it was not ok to do so near a junction0 -
I'd started turning very very slightly and he hit me and of course if I'd seen him over take well about to over take I would not of turned. He hit my car very early on0

What I have learned is other drivers flash you when they have a right of way, ignore them, even if it's harder for them to turn right into a side you are coming out.0 -

Assuming your insurer deducts NCD from a maximum of 5 years (check your policy wording), then expect to have 3 years at renewal.
Your thread title and earlier posts indicated that you are being held liable by your own insurer, yet now you say that they are disputing liability???0 -
You are 100% at fault no question. Sorry to be so harsh but you do not turn until it is safe to do so. Look at it this way if it was an emergancy service vehicle that passed the car that flashed you and you pulled across in their path no difference you was not paying attention I'm affraid imho0
