Car accident with motorbike - they say I'm 100% liable

    If you only hope to get 50/50 then (as posted), were you to succeed that won't make any difference to your future premium/ loss of NCD that you will have now you are being considered fully liable.

    honestly so sorry my op wasn't clear I've had this on my mind my child poorly for 3 weeks now upset going school plus the death in my family

    My main reason for this post was in my opinion I couldn't of done anything different that night if he had not of over took I wouldn't be in this mess
  • Well in my opinion he's liable but my opinion isn't what matters it's down to the instance and he's classed as vulnerable which doesn't help my case. Just nothing I could of changed that night
  • I read it different to you neil.
    I thought that both the OP and the other car were both on the same road coming from opposite directions.
    The OP wanted to turn right into a different road and the other driver coming from the opposite direction wanted to turn left into the same road.

    If it was as you described, the motorcycle would have hit the OP's car on the drivers side and not on the passenger side.
    This is how I read it too.

    The point is that you are unnecessarily beating yourself up over this.

    Unless you can get your insurer to now change their decision over liability to you being blameless then you trying to get it made split liability will have no effect on your future premium as posted
  • Well I would like him to be liable but I'm going call them tomorrow as I'm making a complaint about my insurance 😟

    This is the trouble with people flashing others to go first, not so much an issue until the other driver dithers about, but the driver is so focused on "is he/she letting me go?" that they're not paying attention to anything else that's going on, then they start to feel like they're holding people up, so they rush and suddenly there's a biker (who got impatient with the driver in front, who seemingly doesn't know how to take a left turn).
