Dial-a-phone it is then. Thanks for your valued opinion.
  • My pleasure. Maybe one day I could recommend E2save again, but it doesn't look at all likely given their present actions. I would add that following all the basic groundrules still applies; E2Save WERE a wonderful company once (in the increasing mists of time).
  • Help please. I hope I have not done something stupid.I had one of these price match contracts with esave's CPW O2 tarrif. When I phoned to give notice to the terminate my contact I was persuaded to take out a new contract with cpw.

1 - The bill I am meant to be sending in to claim my fial cashback, although showing that I am still conected, with the same number, it is now showing my new tarrif of £35 per month instead of £40.
Should I be able to get my last cashback?

2 - I was persuaded to take out a new contact, giving me same minutes and more texts. The guy I guess talked the talk and knew I had problems with e2save and said that as a result they were offering me this contract.
    18 month tie in
no phone upgrade within that time
    same number of minutes
more texts as a bolt on after one month.
All this for £5 less per month, with cashback after 6, 12 and 18 months, by redemption and no time limit stiputated.

Of course, this was all verbal and i told the guy that I wanted something in writing. A month has gone by and no contract has come through, and they have simply changed my tariff on my latest bill.
I have been in touch and have emails from this sales guy to the department that deals with letter requests for upgrades, and he has sent them several requests.

What do I do? Should i have just cancelled my contract?
I carried on as it was just easier to keep the contact, especially for my small business. To save the hassle of looking for a good deal. Have I just made things worse?

You have breached the cashback conditions by changing tariff during the 12 month qualifying period, and the conditions do allow them to refuse it. All you can do is claim as normal and see what happens, then take it from there.

You have left it a long time to start chasing for the details of your new contract in writing, and if they have set up something different to what you think it should be you are facing a battle to get changes made. But there is no reason why you shouldn't now pursue them for the details. Don't waste time ringing over this, write and if you get no reply escalate the matter.

Thanks for that Quentin. I asked for the new contact to start after my current one ended which is what they have done. Except the bill I need to send in, because of the price match t and c and because I am on O2 CPW contract, has my new tarrif on it.

I have chased many times since having my contract. Apparently another department deals with this. The guy also told me that all calls are recorded. I told him that is no good to me. Has anyone else been offered a similar deal for being a "loyalty Customer" and did you get anything in writing. I know that the longer they leave it, the more I am paying out each month for possibly a contract I didnt agree to.

"Apparently" is their new name. Never EVER trust ANYTHING this company tells you orally. It's written or avoid like the plague. this has been going on for months among many other disreputable things from cpw. Had you checked beforehand and read the cpw O2 retentions thread you could have avoided ending up in this position. I suggest you read it now since it negates your question. As for giving you a good deal because of the problems with e2Save - well, I needed a laugh...!

I am going through the correct thread at the moment at o2 cpw. For us who are not so sure about getting round this vast forum, it is not easy.
I knew I needed somethig in writing and asked for it on the day I agreed to the terms.
Am I now able to cancel this contract as a reult of them not sending me my agreement details even after repeatedly asking them?
I tell you I am not laughing now!!!

    No.

To cancel on the grounds the contract in force is not the contract you agreed, you need to be able to show what you did agree.

You won't have insisted the contract could only be formed after you received a hard copy!

This is a detailed answer I have just taken the time to write to someone on an E2save thread. Without also copying the rather long and detailed original post by them, I think it worth putting my reply on here, since the comments I am making should apply to many and hopefully help them save time, energy and anger with E2Save. Bringing this thread back to page one wouldn't be a bad thing either - whilst the general standard of research and understanding has noticeably increased since I started it, many still take the lazy route and expect others to help sort out the mess for them later. Most of these problems (practically all, in fact) are readily dealt with on here and other threads - and not just by me. For those who think that harsh, that's fine - try spending as much time and effort as I have on here in all that time and then complain! :A

I admire the detail, so in your case (since you at least do seem to have spent your own time making sure you understood it all first instead of coming on here and expecting others to do that for you, as many do!) I will try to advise.

    First, Onestopphoneshop IS E2Save.

Second, it is extremely common for them to ignore ALL claim date windows and say you've missed them - even when you've met ALL of them (which they constantly try to change anyway). The Virgin sim offer is also notorious - though I'm surprised you got 6 months free that recently on it. Anyhow...

Four months from your connection date (which I am taking as 10th May) is 10th September. 30 days from that date is 10th October. You sent the bill dated 15th September and you can prove (and they aren't disputing this for a change) that it arrived on 25th September, fully complying with the t&c.

Now, I'm surprised they are sticking to the "out of claim period" rubbish - when correctly challenged they usually try to invent a completely unconnected reason for rejection OR start asking you to re-send things.

You have wasted enough time on this. NEVER call them - as you have found, it just wastes your time and money and winds you up. DON'T waste your time either with Trading Standards - and certainly DON'T pay a solicitor. At worse, use any legal assistance insurance you have - but that takes forever and you lose a degree of control. No, send a LBA to the registered address and name (probabaly cpw T/A either Onestopphoneshop or E2Save) from the website (About Us as I recall), giving them 7 days to pay up. Tell them what you will do if they don't (i.e. commence legal procedings) and don't talk about Trading Standards etc. Check out the moneyclaim website - it's pretty straightforward, cheap and effective. Expect them to say they will defend (which buys them an extra 2 weeks to delay things), then make you an offer (probably) and put in an absolute nonsense defence which really OUGHT to be struck out. When you write the particulars of claim, put in some specific details (their defence won't address any of them and therefore should be struck out; even if it isn't, it certainly won't harm your case). Don't expect to have to go to court (but be fully organised and prepared to, making sure your case is clear, unequivocal and proveable). They will do the rest themselves - making their own case more and more ridciulous until the last thing they want is to have to appear in court to defend, where they will undoubtably be shown up for what they are.

    I rest my case...

There is a post on a LBA on here too. I hope this detailed answer will help many more people with this totally dishonest and disreputable company. When I started this thread they had only turned into the current monster three months earlier - so another groundrule to bear in mind is, DON'T be complacent. Just because a dealer is currently superb (and there is still one - obviously not this outfit!) doesn't mean it will ALWAYS be so. You must treat these organisations according to the way they treat their customers NOW - which is why CPW - and E2Save in particular - is a company to be avoided unless you REALLY know what you're doing AND are prepared to call their bluff, ignore their utter stupidity and use the courts if needbe to obtain YOUR money.
