So just to follow this up, as there was a bit of conflicting advice about how to proceed.. do I follow the steps in the Newbie thread, even though it doesn't relate to underpayment by 30p?

    Thanks.

Yes. Use the appeal you have been pointed to in the newbies FAQ thread with the object of getting a popla appeal code

Yes the point is to get a POPLA code and to delay till day 26 if this was a windscreen PCN. Same advice to all at this stage.

Hello. Apologies to resurrect an old thread of mine, but I've had a letter today from SCS Law acting on behalf of UK Parking Control Ltd.

It is asking for payment of £160 which I have failed to pay "despite several letters from our client requesting payment".

It then goes on to say..

"Unless our client receives full payment from you within the next 14 days, UK Parking Control Ltd may take steps towards commencing legal proceedings against you by way of a Letter of Claim. Please note this is not a Letter of Claim."

So from that I presume that this is a Letter Before Claim? Looking in the Newbies FAQ it suggests two threads on how to proceed now. The second thread seems to be more recent as it includes references to new laws that came into force on 1st October, but I think that is based on residential parking, and not that of parking at a Railway station.

Which letter do you suggest I go with? Should I make reference in the response that the people who parked did pay for a ticket, but that it was 30p under the 'full day' amount?

Many thanks for your help and wisdom as always!

Their statement "Please note this is not a Letter of Claim" should tell you that it is not a Letter Before Claim. Letter of Claim is just another phrase meaning exactly the same as a Letter Before Claim.

Anyway, by offering 14 days it is clearly non-compliant as a LBC.

I would suggest you ignore that letter.

Many thanks for the advice Keith.

I presumed that the fact they said it wasn't a Letter Of Claim, and was a prior letter to that it was infact a LBC.

Good to know it isn't. I shall ignore until the next time.

Just to update, so I have a timeline. Today I received a 'Notice of Debt Recovery - Unpaid Parking Charge of £160.00' from DCBL.

As per the Newbie thread, and multiple other threads I shall ignore this letter and only get back in touch should I get a Letter of Claim, or a notice of action by a solicitor/court.

Out of interest, how often would a case such as this get taken to court?

    All the time.

You will get a claim, they are scraping the barrel of old cases and DCBLegal only seem to stop and think about it when people threaten counterclaims.
