ok , got the "bad and not bad" bit , however if an appeal was submitted , using the NTD , then it must exist? , and they are getting info early from the DVLA
we can agree , or argue till the cows come home (tho I agree with you!) they are just taking the $%^$ out of the POFa and like many others the DVLA do not care0 -
By the same token, given POFA’s definition of “notice to keeper” as meaning a notice given in accordance with paragraph 8 or 9 (as the case may be), should we be referring to any non-compliant notice to keeper as a “postal notice” instead?
The problem arises because POFA was so poorly drafted.0 -

I need some advice
I was recently in a car accident, I was going straight down a road when abother car travelling opposite way pulled into my lane of traffic trying to get down a side road .
In my eyes she was to blame for the accident as I was going straight and she pulled into me.
However today I got a letter from my solicitor saying she is not admitting liability
And had to fill out loads of paper work
Is this usually the case? And what happens next?
Is is normal and it is usual. Some insurance companies advising not admit liability as they better of at least 50/50.
I work in the management company. see that v often. Call any other Claims Managemeent company to see what they say.0 -

I agree though that we should keep away from any term that includes the approved terms from the Act.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

Here is response from DVLA:
Thank you for your email regarding this matter.
DVLA is aware of this process being followed by VCS. DVLA has been advised that these “notices” should not be considered as a “notice to driver” but are meant to serve as an indicator that a breach of parking has occurred and a notice will be issued in the post. In circumstances where a “notice to driver” has not been affixed to the vehicle, the company may make a request to obtain the vehicle keeper details immediately to allow a “notice to keeper” to be issued by post.
DVLA has raised some concerns with this process with both the IPC and DCLG directly and is currently awaiting a response. Therefore I cannot provide any further information at this time.
I can only advise that if you feel the notice was issued unfairly, you should use the appeals process in place to challenge this or raise your concerns with the IPC directly.Save a Rachael

The response from DVLA saying that the "notices" should not be considers as NTDs is promising.
So to summarise, do not logon to the provided web address, we are to wait for a NTK, check to see if it complies with the POFA (and check if was received within 14 days), appeal to IPC.

Yes, then ignore them until they try court, defend that - cost them money - and win...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
