and do you have copies of the ORIGINAL NTK
and do you really think PE would have backed down if it was not for the bad publicity?
my suggestion would be to reject their cancellation offer as you intend to instigate charges against them0 -
now you need to get a list of vehicles that take you there put on their "whitelist" , to prevent any further happenings of this type
just shows what involving the local MP,s office and the papers as well can do in these cases !!! lolwell done
it still doesnt make it right though , their office terminals should have a facility that lets you choose your VRM or alternatively only lets you use the ones the cameras took pictures of in their car parks (like when you book in using their interactive terminals that announce your arrival for your appointment)
and they have clearly failed to adhere to the official guidelines from Jeremy Hunt and his department when contracting Parking Lie in the first place
but a result is a result, I did say wait and see how the crops grew once you had planted the seeds , that it would take time
I bet their office manager at that surgery has had some interesting issues to wrestle with this week since his day off too !!!
again , a good result , so get your lottery ticket on , you might transpose 2 numbers and win the jackpot !! ( doesnt work for me though , lol )0 -
and they get away with "we have decided to cancel" after all the debt collection letters and threats of court ,
as of this moment they have wrote to your surgery , not YOU , you are still awaiting the NTK
get a COUNTER claim in NOW for breach of DPA , equality etc etc etc
at this moment you have only their word that
a: entered details incorrectly in a newly set up piece of equipment
b:you overstayed the 90 mins0 -

But if I say I don't accept will it still be cancelled?0 -
dunno , but if you start a counter claim online (£25) , it stops them cancelling
all paperwork WILL have to be sent to you , and I am sure the press/MP and followers of this site would assist in bringing them down
second opinions please0 -
Best to let the PCNs be cancelled, as they have been, no refusing to accept that.
Next - get your VRN(s) on the white list - INSIST on that 'reasonable adjustment' by the Clinic.
If they don't, mention that you are still considering suing Clinic + PE for misuse of data under the DPA, aggravated by the fact that the other two PCNs caused significant distress to yourself, being a person protected by the Equality Act 2010 which cites harassment as discrimination.
Remind the Clinic that the contract they signed disregards the will of the Dept for Health so what are they planning on doing about that small matter, that they are in breach every day they allow these incentivised 'fines' to be levied?
Then when the dust has settled (or not) decide whether you want to sue both parties for data misuse as this regime should not even exist in a NHS facility, so PE should never have been allowed access to your data from the DVLA and that's the fault of the Clinic, for negligent disregard of clear policy. Ignorance of the Car Parking Principles and the DPA data issues involved, is no excuse.
You have six years to claim. Did you submit that ICO complaint online? If so, we'd like to know the decision in the end by the ICO (cancelling the charges does not remove the fact of the breach).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I replied to the MP email and asked that they inform the clinic that so I don't face this hassle ever again my car is added to the whitelist as although I no longer drive my partner drives my car and takes me to the surgery.
I did send of the information to the ICO. But heard nothing back as of yet. The MP wrote to my surgery regarding the DPA also so I guess I should be updated on that soon. I really hope the surgery see sence now and terminate the contract with PE as it causes slot of stress to patients and themselfs too.
I will update when I have a response back from the MP regarding the whitelist. To be honest after the way the surgery handled it and told me not to contact them u less it was a solicitor, I would gladly like to sue them for breach of the DPA!!!0
