Parking Eye HELP!!!

Hi,

I have an outstanding parking ticket from parking eye dated May 2015. I have been unwilling to pay this charge (went up to £160) as the ticket was charged while I parked my car at my doctors surgery to take my child to the doctors. I entered my registration number in the machine inside my doctors but as I am dyslexic I simply put the last two fidgets of my reg the wrong way around!!! I have been receiving threats left right and centr from parking eye and more recently their sister company equita? I have been reading online on ways to appeal but it all seems confusing to me, I am afnamant to pay this fee as I I'm struggling financially and I also feel the fine is Unfare seeing as i was parked in my doctors surgery and clearly it was just a typing error on my part!(parking is free for patients at the surgery as long as they enter their reg in the machine inside the surgery).

The manager at the surgery recently wrote to parking eye on my behalf and I have now received a letter that states 'without prejudice save as to costs' and says as a good will gesture:T they will except £100 and the matter will be closed..

Do I pay up Or do I hold tight and see what happens?

    the fact that PE have passed it to equita is good , normally they scurry of to court within a few mths , perhaps the contract with the surgery does not allow court action?

    It had been passed back to parking Eye as I didn't pay equita. Shall I assume that as it's been nearly two years and no court action that it is just threats?

    never assume with PE get surgery to cause PE grief , show the surgery manager the letter without prejudiced and ask what the **** , the £160 is a figment of equita greed , the parking charge was £100 not £160

    hints or the equality act here , asking a "disabled" (or person who cannot ) to enter info into an ipad , may not be correct

    Equita is also part of the same company, they are just trying a further con to extract money out of you.
    If you have problems with dyslexia why do you think you are at fault, you are even more a victim of their targeting vulnerable people.
    It's dispicable what PE are up to in their greed, go back to the surgery and tell them to call THEIR dogs off it's making you I'll!
    PE have no good will at all I imagine there is little revenue from a small car park and they want their bunce!

    PE have 6 years to try a court cause under MCOL (small claims court) , you may have a counter claim under the Equality Act 2010 due to dyslexia , and your claim if you win will be for a lot more than theirs

    the surgery manager should have cancelled this months ago

    personally I would not pay it (I have mild dyslexia too) and I am sure a judge could be persuaded to throw their case out and award you costs , never mind the fact you could counter claim if you qualify under the EA2010

    so no I would not pay a penny and I would argue it out in court if they try a court claim

    Understanding Parking Eye is important.
    They are a predator company who are high on the colour of money drug. They are simply one of the pond life operating to extort money from people.

    Being dyslexic is a well known condition and beyond your control. Therefore, you need to go back to the practice manager and show the letter from PE.
    You need to ask the manager why has PE ignored him/her ?

    As pappa golf says, you need to quote the equality act.

    The £60 reduction is not part of the ticket and is just PE's use of monopoly money.

    PE has failed to recognize Dyslexia and the problems encountered with this disability.

    The amount PE require of £100 means they have ignored your condition. Your doctor can say different and a letter from your doctor should be requested and forwarded to PE.
    Couple that with a letter from you. By PE reducing the amount means they have accepted what the practice manager has said so both you and the practice manager now require a breakdown of the £100 as this charge should have cancelled.

    A "without prejudice" heading on the letter simply means they do not want a court to read it. A judge can overrule this.

    Very doubtful a judge would would rule in their favour.

    The practice manager must instruct PE to cancel the charge forthwith

    Thank you all for your replies. When I last spoke to the surgery manager she said she had very little say in cancelling tickets outside of the first month they had been issued. She also said that parking Eye could only cancel one ticket and that because i had already had a previous ticket cancelled (this was when I didn't know the car park had parking Eye as it was new that week and I'd been parking there for 12 years to visit my doctors with no parking g restrictions) that she couldn't do nothing on this occasion where I knew about the machine but entered my details wrong.

    The surgery manager explained that the car park is no longer the doctors but rather the councils who have hired parking Eye to man it. It is a very small car park with the only buildings having access to it being the doctors and a pub which has two parking spaces outside..

    I will call the practice manager now and ask that she writes to PE again informing them to cancel it. I had no intentions of paying their ticket but I must admit their scrare tactics had me close u till I read this thread :) thanks guys

    the fact that she admitted a ticket could be cancelled in first month PROVES that the surgery hired them

    cancelation of prevoius tickets has nothing to do with this case

    interesting , did you get a date this happened?

    I suspect something fishy with PEs contract , no contract , or contract on counsil land ?

    PE would have had you in court by now , if something was not being hidden , to be reviled in court.

    The practice manager is really ignorant. Parking tickets can be cancelled right up to a court day.
    There is NO stipulation as to how many tickets can be cancelled, that is simply rubbish
    If it is the council, they will be jointly liable if they employ PE especially under the Equality Act

    If they try a small claim, we have had some defences written already where the motorist has made their best efforts to comply with the machine. And this would be worth defending if they try a claim, you would hope that a Judge is not going to be steered by PE to believe that £100 for a typo by a dyslexic driver is not an unrecoverable penalty.

    Totally different from the Beavis case.

    Can you get a short letter from the Practice Manager in support of your case at least, saying:

    - you had an appointment that day and

    - you are dyslexic,

    so, the surgery would like the PCN cancelled as a goodwill gesture.

    Email that to:

    enforcement@parkingeye.co.uk

    I would do that asap.

    It will also help you if PE refuse and proceed with a claim, because you can show the Judge how you tried to get it cancelled and resolve the dispute.
