If the review is libellous and can be proven to be so (if it is untruthful and not fair comment), then sue the individual. However, since you said that the Facebook page was hardly used, you cannot really argue that your business has suffered as a result, and so you might win the case, but be awarded minimal damages.
I'm struggling to see what result you want from this dispute, if you are not seeking damages.
You have no claim against M&S regarding the review, all you can do is report his actions to them.No free lunch, and no free laptop0 -

I don't have an opinion either way but I wouldn't be making such sweeping judgments without some kind of evidence.

I can't see where the gain would be or the connection in m and s health and safety manager and a Simply food store. Most, if not all, are franchises. As with all franchises it is the responsibility of the franchise to adhere to the rules set out under their agreement.
The health and safety manager would be as cross as you would that the health and safety rules in one of their stores had not been followed whether that be, as I suspect, via a franchise or one of their stores. Or are you accusing m and s of having a health and safety policy that is unsafe? In which case your experience of an injury via one of their racks would have been one of many.
How did the racking hit your wife? it's of unusual to have racking on shop floors in any shop when a delivery has occured and shelfs are awaiting filling. Was it moving at the time or being pushed or free rolling? Or did it have something hard to see sticking out from it?
If it was just static next to a shelf then there is no responsibility with a store, any store, to do anything additional to ensure people do not walk into it. Even if it's blocking an isle, the responsibility to observe surroundings would remain with the customer. Unless there was something that projected that could be unseen.0 -

- It mentioned he worked for them on his Facebook Page, Job Title 'Health and Safety Officer', and M&S confirmed this
Regardless, his review was in response to my complaint (IMO). Clearly he was acting by himself but it was based on internal company information that he had knowledge of. Just imagine you made a complaint and then somebody that worked for the company posted information about it/you or made a comment about you on Social Media. It's a breach of Data Protection (possibly) and overall is just a poor way for a company and employee to act. What's even worse is that they are trying to wash their hands with it.
Anyhow, poor company, poor service. No real surprise they are closing stores and losing market share.
You said you were going to use social media to air your complaint.

It would lay to rest any potential doubts as to the authenticity of this incident if the OP could allow us to see this 'video', obviously edited to not show his wife's identity.
Could you also let us know of the ensuing hospital treatment. If my wife was covered in blood I would possibly have called an ambulance. Just saying.You know what uranium is, right? I've contacted them again. I am all for giving people a chance to deal with things and although I've given them a few already, I'll give them one last shot at it. Then I'll write the story up and post it on Social Media. I will also go to the County Council RE a Health and Safety complaint because I don't think they've done anything to address the issue.
A few points:
- I can understand a few of the posts dubious about events. I'd be the same. Can't stand the people who fake a fall or make up a story and get people to jump on the bandwagon just for some compo. My reply to those comments is simple. We didn't and don't want any compensation at all. All we originally wanted was an apology and a promise they'd properly investigate how they restock their shop floor. Now all I want is an apology and removal of the fake review.
- I'm sure we could have acted differently when my wife got hurt. The simple fact is that she was in shock, I had two children under 3 crying and upset at what had happened and A&E was a mile or two up the road. Simple decision to drive to it instead of fill out an accident form. I couldn't care less what their procedure is!
- The review will have a minimal effect if that on my business but that's not the point. It's the principle of the issue and concerns around Data Protection that worry me far more.
Anyhow, I'll check back in with an update once I have one.

The video wasn't of the accident, it was of a separate visit where items of the restocking equipment were left unattended for a period of time much in excess of what they claimed would ever take place.
Wife had stitches and was cleaned up at A&E.0
