    An interesting thread - has anyone here spotted yesterday's announcement by the Minstry of Justice which is attempting to severely limit the amount of compensation paid out in a personal injury case?

    Basically, unless you are suffering pain from your injuries for 6 months or more you will be paid a mere £400 (about a week's pay).

    Imagine if you broke a leg or an arm and you were self-employed

    Seems that now all the genuine claims will suffer as a result of the small number of fraudsters

    The government proposals (and it's only a consultation paper at this stage) are aimed at whiplash "injuries".

    There is no suggestion that there will be any change if you break a limb.

    Im betting she will next complain when bus prices go up because of an influx of claims because the driver used his brakes whilst people was stood

    If you look at the detail the key measures are:
    • Reduce or scrap damages for soft-tissue injury claims. Minor injuries would be classed as lasting either up to six or nine months.
    • Damages for injuries lasting longer than six or nine months should be graded and fixed according to duration. Minor injuries would receive £400 damages plus £25 for psychological impact. Injuries lasting 19-24 months will have a £3,600 tariff.
    • The small claims limit will rise to at least £5,000. The government’s preferred option is to apply to this to all personal injury claims. A figure above £5,000 is not ruled out. This is the only key measure that would not require primary legislation.
    • A ban on all pre-medical offers to settle. The only question appears whether this should apply only to RTA claims, what exemptions there should be, and how it would be enforced.
    Therefore, if you break an arm in an RTA.......

    Yes, but that won't come in for years. The ops mums fallen straight off the bus onto the compo train. Choo choo all aboard, next stop free money.

    Hi,

    Can anyone help with the following:

    My mum was on a TFL bus en-route to work. The driver was approaching a bus stop and slammed his brakes really hard and my mum flew across the bus with her shopping bags and hurt her back and shoulder. She was holding on to a pole in the middle of the aisle (bus was rather empty) but the driver did not leave his cabin to assist, he didn't even stop and continued to drive. A witness helped my mum up and told her to complain (we have the details of the witness).

    So did anyone inform the driver of the incident? He may have been concentrating on the traffic.

    Why was she standing?

    All the buses I use will not move off until everybody is seated, then when you are approaching your stop you ring the bell and the sensible thing to do is wait for the bus to stop until you get up from your seat. The fact that buses don't start off until you are seated indicates that you shouldn't stand until it comes to a stop. If she is entitled to the magical "compo" I would think it will be reduced accordingly as she will be seen to have contributed to her injury.

    Where do you live?

    I've never been on a bus that doesn't allow standing.

    They do allow limited standing but only when all seats are taken. At other times the drivers tell passengers to sit down. If the lady concerned is not as steady as perhaps she once was, due to joint pain/arthritis, carrying bags, she would be more likely to take a tumble if the bus braked sharply.
