TFL bus injury (compensation

Hi,

Can anyone help with the following:

My mum was on a TFL bus en-route to work. The driver was approaching a bus stop and slammed his brakes really hard and my mum flew across the bus with her shopping bags and hurt her back and shoulder. She was holding on to a pole in the middle of the aisle (bus was rather empty) but the driver did not leave his cabin to assist, he didn't even stop and continued to drive. A witness helped my mum up and told her to complain (we have the details of the witness).

I'd like to know how to proceed, my mum has already seen a doctor about her injury. She has joint pain and arthritis so she's in further pain. This all happened yesterday.

How do I proceed to make a complaint against tfl? I presume it's through their website but is there a more formal process because this wasn't right and we'd like action.

  • Was the driver aware this happened?

    If he was and you haven't got his name, address, the registration mark of the vehicle, the owners name and address and insurance details. I would be reporting this to the police.

    If the bus was "rather empty" why was your mother not seated? Did she lose her footing and fall over or just momentarily lose her balance? Was the driver aware of what had happened to her?

    AFAIK all TfL buses have internal & external CCTV, so any claim should be capable of substantiation (or not),

    They are not going to pay out for this.

    If your Mom was injured then the driver has an obligation to treat the incident as a road traffic injury related incident. If the driver did not 'exchange details' then the matter should be reported to the police within 24 hours.

  • If she was successful in claiming expect any compensation to be reduced, because she contributed to her injuries by choosing to stand on a rather empty bus.

    How is this in anyway a police matter.

    Ignore those that say there's no claim. See a solicitor. You should get a free 30 mins interview.

    I don't think this is true in the slightest.

    My father was a bus driver some years ago and had a similar incident. The police were called and had to be notified. He ended up getting done for Driving without due care and attention. So yes, it can be a police matter.

    With a PSV licence and vehicle you are responsible for more than just the vehicle.
