DW sports/Soccerdome Wigan Parking Charge

Hi,

I have never had a parking ticket in 14 years of driving and have come home from holiday today to a parking eye letter, demanding £100 or £60 if paid by November 5th. I would like advice as to if its worth appealing?

The PCN says the event happened on 9th October and was issued on 22nd October. The car park in question is located to the right of soccerdome and dw sports which are both signposted on the front of the building.The car park appears to be split into 2 areas (left and right) and upon visiting the area to see for ourselves it appears the PCN is referring to the right one. There is one barrier which is in the up position and this would block off entry to the whole car park not just one area.

The letter I have had says my car was parked in a dw sports members only area. I rang them today and they say yes the area to the right of the car park is for members only even if you pay.
My husband has gone back up today to have a look and has sent me a few photos which I will attach.

A few points we hope are in our favour:
* the front of the soccerdome has 2 signs, both close to each other saying dw sports and soccerdome.
* as a car is waiting to turn right off stadium way and into the car park there is a massive sign saying sports store and cafe open to non members - insinuating that the car park is for other users
*as a car would turn into the car park section in question there is a sign saying patron only car park. It is not at head height, it is quite high up. When my husband returned today there is a smaller pop up sign saying members only but this is a pop up sign and not a permanent sign

Can anyone please tell me how to attach photos which I have on my laptop?

    Please edit your post and remove any reference to the driver's identity.

    We drove in, or the driver drove in, not I drove in. Got it? Good.

    Never ever reveal who was driving, and never, ever, ever 'phone a private parking company.

    Please then read the Sticky thread for NEWBIES then appeal using the BPA template in blue. Copy and paste and send. Do not edit it.

    That's phase 1 done. Once you get the inevitable rejection from parking lie, you will then need to create a PoPLA appeal.

    Concentrate on getting the initial appeal out before the deadline, then start collating your evidence for a PoPLA appeal.

    To attach (redacted) images, upload them to a web hosting site such as tinypic or photobucket then post the URL here, but change http to hxxp. Someone here will then change it a live link.

    Make sure there is nothing that can identify anyone when you post them. No PCN number, no VRN, no names, no other pictures in an album on the web hosting site. No I did this in your words.

    You can say, I am the keeper and the driver did this, or didn't see that, but you must be very, very careful not to even hint who the driver was.

    It's a second stage appeal that you send in online. It's supposed to be independent but is actually funded by the parking companies via their trade association.

    It would be useful for us to see a redacted copy of the PCN/NTK, but concentrate on getting the initial appeal out first that's in the NEWBIES thread.

    Once that's done you then have several week to collate the good stuff that will see this off at PoPLA.

  • I will send the initial appeal tonight. I'll scan the letter in and remove anything that identifies me. My mum has been house sitting and said the letter arrived yesterday as the envelope said this is not a circular so took her attention yet the letter date is 22nd October.

    When did the letter actually arrive, as I believe they will have missed the deadline to transfer liability to the keeper?

    this section of the car park only moved over to ANPR system some time in August and I am expecting that there will be many more like this to follow ....... Even I did not spot the change until last week and I am there twice a week.......

    OK if it is the same then do not worry about posting it up .......

    with ANPR they need to send the letter to you within 14 days ....


    so no letting them know who was driving .... you will need as advised to send off the BPA template (blue) that is in the newbies thread .....

    as above where you using the gym section ... or do you use it at other times ?
