He wouldn't have to, just on the balance of probability it would be a civil court not criminal.
Balance of probability or reasonable doubt means the same to me. Its just a case of would you believe my version of events.
Just curious how the OP will prove that their vehicle was damaged by the cuttings on the road in that exact spot and prove that tyre actually came from his car.

many years ago 1991 I think I lived in a static caravan on a farm in an area I had newly moved to. In 1 week I had 2 punctures due to hedge clippings on the farm road. The first one I got mended the second was unrepairable. I spoke to the farmer (my then landlord) who kindly covered the cost of a new tyre just got it done at the local place he used and added to his account with his agreement. It was a 1985 polo Coupe S so 14" wheels I think.
So OP I think it is worth a try, speak to the guy politely (it wont be the first time he has been asked) but if you get nowhere possibly best just to let it go.0 -

yes i even have the car service print out done 8 days ago saying each tyre had 7 mm left on and 12500 miles left in them0
