thanks for being helpful, are there any specific bits of legislation on this you know of on this? Is the general negligence and personal property damages laws the main relevance?

if worth pursuing, i would have thought the letter before court action would be enough to encourage a cough up.

How can you prove his hedge trimmings caused the puncture?

because the road was covered in them. its the only hedge that has been cut within a few miles.

i have photographed the road / location covered in thorns and the thorn stuck in the tyre on the road where all the thorns are spread.

The puncture was that severe it would have been impossible for it to have occurred from elsewhere other than the time i drove out my drive onto the road, straight into the spikes and bam.

Sounds like you've been negligent in doing that.

You have proof that will stand up in court and beyond reasonable doubt?
I think i could pick a few flies in it.

You knew it was there several days ago and still drove through it? How many calls did you make to report it? Got proof?

Only hedge within a few miles, want to test that in court also?

I hope you kept the tyre for evidence.

One went into the side wall and to cut the story short was a whole new tyre at £82

Can you explain how a thorn entered the sidewall when you were driving?

they are done by contractors and none of them clear the roads, and most of them don't make such a bad job

The road has still not been cleared and never will be

no, the road is covered in hedge cuttings and small bits etc, but i did not realise many of them were covered in thorns.

All hedges here are cut in jan / feb here apart from this one so yes only one in the area to have been cut

what evidence is keeping the tyre? a photo of it with the thorn in and then punctured is good enough?

How old was the previous tyre?

I doubt this has actually cost you £82, if the old tyre only had say 4mm of tread left then, it's cost you more like £50. At which point you have to ask whether this is really worth the hassle.

He wouldn't have to, just on the balance of probability it would be a civil court not criminal.
