Tyre damage from bad hedgecutting

Hello,

I have just had my tyre punctured on the road right outside my house where a hedgecutting tractor has splayed hawthorn spikes all over the road.

One went into the side wall and to cut the story short was a whole new tyre at £82

i have definite proof that the puncture was caused by the cuttings outside my home. I know councils have to pay out for damage caused to vehicles and anyone else who damages someone elses property is liable to pay up.

Is it worth sending the hedgecutting farm contractor a bill with the evidence their actions lead to the damage and incurred cost?

    Who owns the hedge?

    Had they finished the hedge cutting when you had the puncture?

    Ah, you bought a "whole new tyre" you should have just bought enough to replace the punctured bit.

    yes it was done on friday, puncture happened today.

    it is owned by a farmer, cut by a contractor

    So what is your evidence?

    I don't know how many bicycle punctures I had to repair for hedge cuttings, never even thought of making a claim.

    This is the hedge cutting time of year, if they didn't cut them you would be moaning when they were obstructing the highway!

    sorry but most hedgecutters dont leave the cuttings all over the road. This is a case of bad hedgecutting not just hedgecutting

    most hedge cuttings dont have huge thorns on them.

    i have my own hedge along the road and i sweep them up.

    if i scattered thorns all over the road and punctured peoples tyres id expect them to want me to pay.

    surely it is just basic negligence to leave spikes all over the road, may as well have thrown nails on the road.

    as a cyclist i know only too well that hedge cuttings = huge thorns!

    if there is no clear path round the clippings i will dismount and wheel the bike past the clippings and check the tyres before remounting

    car tyres are a lot thicker so less risk than on a bike, but not zero risk

    The farmer and his contractor is under a legal duty to clear up any mess they leave on the public highway, and this will include hedge trimmings etc. OP, I would definitely make contact with the farmer but you could be in for a bit of a fight to get recompensed.

    thanks for being helpful, are there any specific bits of legislation on this you know of on this? Is the general negligence and personal property damages laws the main relevance?

    if worth pursuing, i would have thought the letter before court action would be enough to encourage a cough up.
