Dear Sirs,
I write on behalf of Ms Julia Davis. I am aware that you have been copied in to an email that was sent by your client **** to Ms Davis on 6th January 2008.
This email was very upsetting to Ms Davis who is currently suffering and being treated for serious depression and trying desperately to cope with her financial difficulties, homelessness and her appeal to the Housing Department of Dacorum Borough Council.
Your client ***** has been harassing Ms Davis for some time and I would ask you to instruct your client to desist from this behaviour. Sending emails of such an unnecessarily vindictive nature is helping no one. ***** has placed the matter of rent arrears in your hands and he should not be undermining your instructions by pestering and harassing Ms Davis.
Ms Davis' application to the Council for a home does not concern ***** and he should not be interfering in this matter. I would have thought that it would be in ***** interest that Ms Davis gets settled in a permanent home, is able to continue the treatment she desperately needs to get her in full health so that in time she can find employment and get her finances on track. This is her intention and ***** should not be undermining her efforts.
There were a number of comments in ***** email which Ms Davis takes issue with, most of which she does not wish to waste her energies responding to as they appear frivolous and designed as a 'revenge' attack upon her at a time when she is extremely vulnerable. Such comments are those he relates to (a) the children's father taking the twins to Spain for a holiday - What has this to do with Ms Davis' rent arrears? (b) That she had her hair done for a press photo. This was done by her hairdresser friend and was free. (c) That she turned down an opportunity of employment offered by ***** - Ms Davis tells me the interview was in Wales, that she had no desire to work for ***** or his family and in any case was signed off by her GP at that time and unfit for work. (d) That she hid facts from her father and boyfriend (me I presume), though what these fact are or their relevance to anything one can only guess. (e) That she should 'change her ways and do some work'. ***** should know that Ms Davis has been suffering from a hip complaint and serious depression for some time and is not fit to work, as confirmed by medical professionals. (f) Comments about Ms Davis' membership of Sopwell House Health Club. He should know that this membership expired over 12 months ago and has not been renewed due to her financial difficulties. (g) Comments about my paying for Ms Davis to accompany me on a holiday to Egypt, such comments which have been made before and a subject which I personally took issue with ***** on. He obviously takes no heed of what I said to him at that time. How I spend my money has nothing to do with ***** and I did so because I could see how Ms Davis was suffering and felt it would do her some good to take the opportunity whilst her children were in Spain with their father. I also welcomed her company on a holiday I badly needed, having had stressful time myself.
On the issue of damage caused by BT to a wall at the property ***** ***** ; Ms Davis sent numerous emails to BT regarding this damage, copies of which were forwarded to ***** at the time. Ms Davis also provided ***** with the BT reference number, relating to this. **** ***** is owned by ***** and he should pursue compensation from BT himself, or have his legal representative do so; it is not Ms Davis' responsibility to chase this.
Ms Davis does have the receipt for the dishwasher and apologises for the delay in providing this which was due to her ill health over the past 12 months and her preoccupation with more pressing matters. The receipt will be forwarded to you within the next few days. Please let me know to whom it should be addressed.
In closing I would like to say that Ms Davis has nothing, no savings, no income and no home. She is struggling to make ends meet whilst paying exorbitant storage fees for her belongings. ***** has the benefit of a comfortable home and ownership of a farmhouse and two cottages. He should be a little more sympathetic to Ms Davis desperate situation. She didn't ask to be where she is now. Does ***** really believe that Ms Davis deliberately put herself and her children in their current situation?
Ms Davis is anxious to ensure she finds a comfortable home for her and her children that can be a permanent place for their future. She also wishes to get herself well, so that she can seek employment and provide a brighter future for Adam and Felicity.
I ask you to convey to your client ***** that he should leave legal matters to yourselves and stop communicating disturbing correspondence to Ms Davis. It serves no purpose other than to cause her anguish, which it seems to me is his intention.
