Morning all,
Thanks for all your posts - shall reply later as have Drs appt at 8.30am xxChristians Against Poverty - www.capuk.org0 -
Been to Drs, he is arranging for me to be referred to the CMHT and I am providing him with a copy of the psychologists report which I am picking up from I-T's today. He had also booked me in on 31st January to have a cyst cut out from my back - this flared up last June and was infected for months so lots of antibiotics, and when it had calmed down enough to remove it was at the time I was due to move and I couldn't bear the thought of having to deal with that as well as everything else. But on Christmas Eve it flared up again and now I know that I need to have it removed as it is getting worse:o. I seem to be susceptible to cysts whenever I am stressed - I also have one under my left eyelid that flares up each time I am really upset - so its up more than down! My previous Dr wanted to remove it/send me to an Opthalmic Surgeon just as I was about to move from the marital home so that wasn't done either. And since I have been here and having to deal with one crisis after another I still haven't arranged for that to be sorted yet!
Spoke to solicitor too, she is faxing psychologists report to I-T's for me this morning. She has also heard from the Council today saying that they are sending more information to her (guess its not helpful info to me) and in view of that she has until Tuesday 15th to put in her representation, giving us time to defend what they say. She said she will be in touch again later today.

In fact they are considering asking for the panel to be made up of members from another council due to the rumours flying around within DBC that I was taking expensive holidays whilst a tenant in the cottage - this news came to my attention today!!! I-T did take me to Egypt in Aug for a week for which I paid not one penny towards, and during the previous year he took the twins and I away twice for a few days in this country again paying for everything. These rumours can only have come from one 'source' who would have known that I was actually away so could be prejudicial to my case!
I agree that the Appeals Panel should be made up of people from other councils - after all, this would be standard proceedure if it was, say, a Police internal enquiry.
One thing that your story highlights, above all else, is that DBC's overal behaviour/attitude towards 'intentional homelessness' is, to say the least, questionable. This, in itself, should be sufficient to warrant an independent enquiry into DBC's housing policy, and I, for one, would be happy if it were announced that the whole council were to be placed under investigation. They have treated you, and others, disgustingly and deserve to be investigated.
Your holiday to Egypt is totally irrelevant to your case - gift or otherwise. EVERYONE is entitled to a holiday - even in bankruptcy, the Official Receiver allows a certain amount of money to be 'budgeted' for holidays.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

DBC showed negligence by not acting correctly on the NowMedical report who said 'it may be prudent to obtain a psychiatric report' and when my solicitor arranged this for me the Head of Housing told her that I didn't need one - more negligence!Christians Against Poverty - www.capuk.org0 -

You deserve a fair hearing, mot, and you have done nothing 'to regret'.
Hopefully, your case will pave the way for other similar cases to be viewed more sympathetically, and professionally, not only by DBC, but by Councils accross the country.
If, as a result of your case, DBC do receive criticism from the highest level, then, I'm afraid, I will show them the same level of 'sympathy' that they showed you when all of this started.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I would be tempted to ask for proof of their medical qualifications that enables them to dismiss the advice of the agency with whom they have a contract to provide medical evidence & advice, particularly now you know the extent of those problems. Maybe they are planning to save money by being able to provide in-house medical reports, by asking one of the Housing or Homeless staff what they think of an applicant's medical background!

Hi MOT
I'm glad I made that call it sounds like it was the tipping point for an independant pannel which I hope comes off. I'm glad the Dr's went well today you really do need to look after yourself.
take care and you know how to get hold of me.

Received psychologists report - it makes very interesting reading! I will let I-T have a look at it but won't post it on here for a few days for obnvious reasons! If you would like to email me I will send you a copy if you are interested!!
Whilst writing I have heard from MM who has said that the Council have agreed it would be detrimental for Chair of Appeal to sit on the panel due to her connections with the W's. They are also considering the request for a totally independent committee from another local authority but at this short notice he's not sure how this will work out.Christians Against Poverty - www.capuk.org0
