    The point about the law making sure you have enough to live on is a valid point there. Maybe HB did actually make a mistake? Might i be cheeky and ask exactly what they were paying you towards your rent? and what your SSP was at the time you applied? We might be able to gather information based on that, to see if you were in fact underpaid by HB. I doubt wether they would backpay anything but it might help in your fight to prove you haven't intentionally made yourself homeless.

    I understand the annoyance about the council saying the house is too big. I'm having this myself at the moment. I had to go on IB myself at the end of March, after paying the rent myself for 14 years. My DH is on minimum wage but i was on quite a good wage so we lost the majority of our income. They finally made their decision in AUGUST!! and i got a nice letter telling me that they were taking money off for my dining room/ garage etc, and i am entitled to a whole £8.34 a week.

    Unfortunately we now DO have to move, as im sure you are all aware, when you work, you have the money to take on extra commitments that you wouldn't normally be able to afford whilst relying on benefits, like buying things on credit or having sky, using a credit card cause you know you can afford to pay it back each month. Things like sky we have cancelled, but things like the credit cards you can't, you still have to find the monthly payments.

    It's a vicious circle and yes im upset about having to leave my home after all these years, but as my landlord pointed out, as much as we have been great tennants over the years (he has been great over the years also) he still has to pay the mortgage and can't let us build up arrears till i can go back to work. Fortunately for us we have a huge deposit in the place and have only improved it over the years so he is more than happy to give it us all back in advance so i can pay a deposit on somewhere else.

    It's still a big upheavel though and I can only imagine how you are feeling right now having to contend with everything else also. All i can offer is the advice about letting one of us try and get some info on wether HB may have made a wrong decision in your case.

    Good luck with everything and your sound like your doing an amazing job of sheilding the children from all this upset.

    omg i have read the thread hb its totaly relevent at the moment as if the op has been under paid the op can claim backdated hb payments what would help with remove cost

    the fact the op could aford it at one point but then the situation changed is relevent as thats when the op could of followed the councill advice and move to a cheeper home and thats what the councill is using to say that the op is intensionaly homeless their view not mine

    alot of coucill are now running a scheme that they will pay your depoist for you and most councill are using this to rehouse homeless people back into the private sector as they just have not got the councill houses to let out and they dont want you sitting in temp housing on there list as it looks bad for their councill to have to many famleys living in temp housing so if mot can get the money for a new deposit and remove cost it will save the op all this stress as the op can just re rent of someone else not ideal but at least the op will have a roof over there heads

    I have already mentioned in a previous thread that I could not afford to move to a cheaper home in the area due to a) not being cheap enough due to my circumstances b) lettings agents saying I don't 'earn' enough and that they won't take benefits etc into account and c) because I had no money for removals - at the time I wasn't aware of crisis loans and the like.

    Also the moving initiative offered by councils - I wasn't eligible for this due to b) above so I was told by the council.

    I apologise for seemingly 'attacking' you but some of your comments were not at all helpful and I have been through and am still going through more than enough stress for one person to cope with, so whilst you had one or two valid comments which didn't really need addressing at the moment, your other points were hurtful and unnecessary.



    I have had and am getting a lot of constructive help and support on this forum and for that I am eternally grateful :A .

    regarding the lettin agents saying you dont earn enough could you get that in writting as that would prove that you sought to find cheeper housing and couldnt

    regarding cheep enough ask your local letten agents for some details of the same kinda of propertys you rent now to prove to your councill that there is no cheeper houses in your area

    regarding moving initatives mybe now you would be eligble
    failing that try the private add in your local area for housing some landords dont mind dhss

    Good idea about the comparable rented properties earwig - thank you! Have printed some off Rightmove for the council tomorrow. Will speak to HL Officer also tomorrow about your other suggestion and apply for crisis loan also when at council offices.
