Maybe a carefully worded email to her boss, stating that you need the file to enable Shelter to review the decision on your behalf, might be in order, asking for the file ASAP, not "when a date has been set" as that could be 2 weeks away.
Also copy it to your person at Shelter, for their information.

MOT - those housing officers seem to have 2 speeds - stop and reverse. I am with everyone else on this thread who is disgusted at the way you and your lovely kids have been treated. The worst of it is that you are genuinely in need of their assistance and keep getting fobbed off but I'm sure that the person in the houseing office shouting and screaming will get put to the top of the list even though they are the ones that dont' really deserve the help.
My thoughts are with you and your kids, hopefully they may realise this and start helping you.

Can I suggest that you go to the doctor's (preferably with the letter) to ask for medical support/counselling to help you deal with this new situation. Not because I don't think you're a very capable person (you are), but because it can then be used as proof that you do need support when dealing with these things. If you 'manage' then sometimes your strength is used against you - to 'prove' that you can cope! Makes me :mad: but there it is. If you go then you're building a record and you then have proof that that woman in housing doesn't appreciate how near the edge she's driving you - and is, in fact talking out an orifice that isn't her mouth! :rolleyes:
I'd also write telling her how much it's wearing you down and that, once more, you feel the need of counselling etc Then they can't say they didn't know!
Have you got your MP involved again yet? Perhaps now is the time?

Shelter will not be able to help until they have the file as they will need the contents to make any challenges, It is essential that they see exactly what information the local authority has used to make their decision.
The only person in the Authority who has control of the budget for homelss accomoadtion is the manager so she i will need to be consulted before a decision can be made to continue with accommodation. The law says that they have a power not aduty and they will lokk at the strength of the case before agreeing to continue with the accommodation.
IF THEY REFUSE TO ACCOMMODATE PENDING THE OUTCOME OPF THE REVIEW MOT NEEDS TO TELL SHELTER STRAIGHT AWAY AS THERE MAY BE A POSSIBILITY OF A JUDICIAL REVIEW OF THEIR DECISION NOT TO ACC PENDING REVIEW. THIS REQUIRES AN APPLICATION FOR A LEGAL CERTIFICATE AND NEEDS TO BE DEALT WITH SWIFTLY.
In my area it takes a week to get a copy of a homeless file there is a lot of info to photo copy, many authorities make a charge for supplying this file as well.

no need for 2 months notice only 4 weeks as per the protection from eviction act 1977 as mot only has a licence to occupy not a tenancy of this flat.

Good info; I didn't know about the tenancy situation.
Hope it would be helpful to outline an absolute worst case scenario. Not to worry you, just as a basis for discussion and hopefully to show you that even the worst case allows time for your appeals to be heard while you are still in this flat.
HA apply for a court date following MOT being in residence on 19 December? The date given could well be the following week, say 28 or 29 December. Then I imagine MOT will be given 14 days to leave - so now we are at mid January. At which point HA go back to court to get an eviction date. This generally seems to give another 7 days grace. So we are talking end January before baliffs would appear.

He has been aproached by the council to complete the medical form which he did about 10 days ago (possibly too late) but has confirmed my depression :T he agrees that the form was vague and says that he is prepared to write a more lengthy detailed report once I have seen what he has written initially!Christians Against Poverty - www.capuk.org0 -

I am a journo and we aren't all !!!!!!.
We do often carry stories along these lines and it amazing how quickly things happen when you call the council for a quote on the situation.
