  • Hi MOT, havent been on for a while (work,visiting my nanna etc) but youve always been in my thoughts hinney. Just reading the last few posts Im livid that you cant have any flaming peace of mind. I agree with the others, why the hell dont these people move their backsides and help rather than hinder you? If any of them are reading your thread, I hope they feel ashamed at what theyre doing and I also hope they are shocked by the amount of support and the excellent advice you are being given by people who genuinly want to help you.
    Im sending you and the bairns, I-T and your wonderful friends the biggest hugs and hope the next week brings you some good news mee darlin cos God knows you deserve it.
    (My temper on typing this has nearly broke my keyboard!)

    Morning all,

    Why o why do we have to get up early on Monday mornings???

    Anyway, had a very relaxing weekend with I-T, did absolutely nothing apart from sleep, talk, eat and relax.

    Have got Chiro appt first thing then will start to make list of all the things 'to do' to get this appeal in motion. Yoga at 12noon (arranged by MIND) then HA Support Worker here at 1.30pm.

    I have emailed LHO asking her about the Eviction Notice on this flat so will let you know later when I get a reply.

    hi mot sorry i havent read for a few days as to be honest i thought all this was now sorted did you find out about your hb i know i keep banging on about it but this is what they have you on that you didnt pay your rent and thats is why you are homeless so if you havent found out yet you must today if you have lost the paperwork go down to the councill and ask for a copy of your old housing benefit claim

    like i have said before on the back it tells you what the laws says you have to have to live in mine was 196 per week so my rent was 138 per week so i got full hb but if i had been reciving 220 than i would of only recived 114 hb has i was reciving 24 pounds a week more than the law says i needed to live on

    i think this is the key to getting accepted as the other stuff is not working the councill would of delt with loads of cases like yours so they must be confident that they can up hold this descions if you was not reciving what the law says you had to recive to live on then the fault is theres and they would have no choice but to house you however if you was reciveing what the law says you have to i dont think there is much else you can do as they are clearly not intrested in medical reasons

    so if you havent allready (sorry havent had time to fully read the last few pages) chase up your socail loan regarding deposit if landlord hasnt returned your old depoist chase that up to start looking in to private renting and get the hb team to give you a qoute on what you will be entillted to regarding hb they will give you a form you put down your information and they will give you a quote in about a week i know this isnt ideal but at least it is a back up plan good luck with it all

    Forgot to say that when I got back to the flat at teatime there was a letter pushed under the door from the Housing Assoc (who own the flat) serving with me with an Eviction Notice and we have to be out of here on or before the 17th December 2007!

    My heart sunk when I heard this. I am so angry about the way you have been treated. I can’t help but wonder if they just got you in that place to clean it up. I really hope you are told you can stay pending your appeal, they should at least be weary that Christmas is round the corner. Stay strong.

    I thought tenants were legally entitled to 2 months notice.

  • I cant belive they let you sepnd all that money that you dont have on removals and cleaning the s**t pit up only to serve an eviction notice!!!

    clearly someone somewhere along the line MUST of known this was gonna happen.

    I was pretty sure that you are intitiled to stay whilst the appeal is happening.

    I only wish i had half of your strength and determination and i hope it sees you through.

    Just a thought.

    Was the letter addressed to you MOT, or to the occupier.
    I don't know how long the flat was empty for, but could the notice have been for the previous tenant?

    I agree that you need to be given 2 months notice, so could there have been a mixup?
