My flabber has never been so gasted! It absolutely beggars belief that these 'people' (are they actually human?) are treating you like this. I just don't know what to say as most of what I am thinking (about the people dealing with this) isn't printable on a public forum but it is something like

      %^@****"!

Have you had the meeting at the MP's surgery yet? I really hope he can put a rocket where the sun don't shine on these people.

Also the point made above about the HB seems worth pursuing.

Best of luck this week. It does make you think. I have no heating or hot water, and it looks like I will be fighting the insurance company between here and Christmas 2008 let alone 2007, but at least I do have four walls around me and know that we have a home.

I truely hope something miraculous happens this week.

    Just a thought.

Was the letter addressed to you MOT, or to the occupier.
I don't know how long the flat was empty for, but could the notice have been for the previous tenant?

I agree that you need to be given 2 months notice, so could there have been a mixup?
Unfortunately, the letter does have my name on it!

Received email from the LHO at the council who said it is a standard thing when a negative final decision has been given and that the right to stay is at her Managers discretion! Her Manager has been off for a couple of days but is back at work today so I should hear something soon.

Did you hear back from Adam Fullwood?

And was "Seasons Greetings" the one with the different bits of family that keep turning up? I think I've seen it & it's very funny...just what you needed :D

Yes Floss, thats the one! I could really relate to the stressed out housewife/Mum who had to do everything - she was so funny!

Yes, I heard from Adam Fullwood's junior clerk who said I need to be referred by a solicitor - so now to find a solicitor in Herts who specializes in Housing law.

That's where Shelter should be helping you - shower of poo that they are. They should be taking on your appeal & instructing their own solicitor.

Have you had your copy of your file yet? or is HLO stalling on that one?

This unwelcome eviction notice would presumably be the first stage in an eviction process. I would imagine that the housing authority would have to go to court to actually gain the right to evict you. After which they would have to go back to courts to appoint baliffs to physically evict you.

The second hearing, should you fail to leave on 17th December, would probably give you 2 weeks to leave and then a further court case could take a couple of weeks to get a hearing, so chances are you will not be evicted before mid- Jan. Unless someone else knows that different rules apply here?

Not received copy of file yet, but she said that she hasn't done anything about the appeal yet as her Manager was off! Think I'll email and tell her I'm coming tomorrow morning to collect it!!!! Also Shelter won't see me until I have the copy of the file

Does she not know what to do, or is she not allowed to do things on her own?! Glad to see they are treating it with some urgency

It wouldn't be hard for her to photocopy the file....bet an email to tell her you will collect will result in a reply from her saying "no you can't".

    Here's her answer Floss!!!

"Because you have requested a review, once a date has been set you will get a copy of your file. The whole file needs to be photocopied and i'm afraid this cannot be done today. I will send you your copy as soon as it is ready."

I have also spoken to a woman I saw earlier this year for some counselling via a local charity (part a recovery fund because of a major incident in the area we live) she has said for me to write a letter detailing EVERYTHING that has happened to me over the past few years, send it to her for 'tweaking' and she will sign it and let me have it for the appeal.
