Hello there,
I wrote a lovely long post and then lost it! Grrrrrrrr!
It seems to me that the three words that clinch the deal are *suitable affordable and available*.
So I think you need to do a two pronged attack - obviously the house was suitable, or you wouldn't have taken it in the first place.
Was it available? No, because the landlord wanted to sell it. Can you prove that? On your eviction notice does he give reason to you and to the court as to why he wanted you out? Is it mentioned at all? Can you take a photo of it with a for sale sign on it? Can you get house details from an estate agent with it up for sale? I would gather all the proof you can get on that side.
Affordable? No, it wasn't affordable (to you) because of the problems with your mental health and housing benefit.
If it was me going into this appeal I would do two things. Firstly take up Princess Janes' offer of some publicity, not least because this could lead to a solicitor offering to do a pro bono case, which would be fantastic.
Secondly, I would definitely lean towards the availability thing, because I think that housing are doing all they can to make you lean towards the housing benefit issue. Of course you will need to provide as much evidence as possible to show that you were unable to cope due to poor health. But at the end of the day you need to make the appeal people look at the fact that if you had all the money in the world, and the landlord wants you out, then that house is not available to you.
I wonder if the kind people that lived near you, the ones that helped you out with your packing and stuff, if they could say if the landlord wanted to sell the property? Did I read they had the same landlord? Any evidence that the landlord wanted/wants to sell the property is what you need, as far as I can see, is going to really help you.
I hope this goes your way, I will be following this thread with interest as I have from the beginning! I am sure it will!

Mot - I am more than a little worried about the possible 'lack of impartiality' of your particular HLO, having read through the last couple of pages.
I appreciate that one of my 'hobby horses' is the way in which Local Authorities use, or abuse, the 'power' that they hold over ordinary people and the 'apparent' lack of concern as to how their decisions may affect lives in the interests of meeting targets. So I am really trying very hard not to let my feelings prejudice any thoughts in your case - but it is becoming increasingly difficult to maintain an unbiased view of the whole process that you are going through.
I appreciate that I may be jumping, unfairly, to conclusions, and would dearly love to believe that your HLO is treating your case with the compassion and respect to which you are clearly entitled.
Unfortunately, I have had many 'confrontations' with 'public and civil servants' and have found that the overwhelming majority of those that I have had the displeasure of dealing with, simply pay 'lip service' to the charters to which they are signatories.
Rather than make any 'unfounded allegations' about your particular HLO, it would appear that there could be an element of the attitude that I have experienced emerging in your case. (I think I have phrased that diplomatically enough.)
Could you, please pm me the details of your HLO, so that I may see if there is an emerging pattern in the way that she deals with cases similar to yours?
Thanks.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Couldn't have put it better myself rog2....what also concerns me is Shelter's defeatist attitude towards the Council and lack of willingness to support & take on this case.0
