However, Shelter's website says: "If you didn't pay your rent or mortgage because of financial difficulties that were beyond your control, the council should not consider you to be intentionally homeless"
This is definitely the route to emphasise.

Couldn't have put it better myself rog2....what also concerns me is Shelter's defeatist attitude towards the Council and lack of willingness to support & take on this case.
It concerns me, too, floss, but I'm not sure that it would be fair to direct too much criticism at Shelter - often, with charitable organisations, the 'usage point' is staffed by well meaning, but often over-worked, volunteers, who may feel that, sometimes due to having dealt with the particular council/hlo in the past, that they are unlikely to get a result, and they become disillusioned or 'battle-weary'.
In my opinion it is worth 'pushing' Shelter by asking to speak with someone who is a 'specialist' in this type of case. There are, also, other charities, such as CAB and even the Church, who may be able to give MOT advice and practical help/support.
Also PUBLICITY may be one of the 'strongest' weapons in mot's armoury - No Council is going to like the headlines of 'Family Made Homeless one week before Christmas'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Sorry, but I had to shout that out MOT.
Started reading your thread at 1pm this afternoon and have just finished.
Keep going with this. You will get a result. You seem like a very genuine and honest person and you have a hell of a lot of support behind you. :A

MOT and I had a nice weekend at my place. I did the waiting on her hand and foot bit and wrapped her in a blanket so that she could have a sleep whilst I prepared the meal, cooked a nice meal, plied her with brandy and coke apperitif, then red wine, followed by more b&cs'. I wasn't going to let her lift so much as a finger. On Sunday morning I laid a towel & pillow on the living room rug, closed the curtains, lit candles around the room, put on some soothing music and gave her a massage. It really seemed to relax her and in a strange way did the same for me too. Then, BAM! All day yesterday I felt off stroke without understanding why. Last night I went to bed at 10pm, woke at 2am and with my mind racing like the Devil in a hot rod I decided to get up and go on the computer and there I sat 'til 5am. Woken by MOT after 8 ringing to see if I was ok. I had a horrendous headache which later became a migraine so I think my body is coming out in sympathy pains! It seems every day officialdom throws another brick at MOT and we just wonder how much more cr-p they can find to pile on her. So, all in all I'm trying to be strong for her and struggling to keep a positive frame of mind. All your good will messages and advice certainly help. Mille grazie.0

Whilst Shelter is A Charity it is funded by the legal services commision to provide legal advice and advocacy on all housing issues, the staff are not volunteers but fully trained legal advisors and often solicitors.
They would not make a decision not to represent unless they have experience that this would be dertimental to the client and certainly not because they are battle weary.
Unfortunately Local authorities are facing severe problems because of the lack of housing and often take a very tough line. they know that if they make a decision that is adverse even when it is obvious that it is wrong the applicant may not be able to challenge it because they cant afford to. unless they are entitled to legal aid they often can not afford to go down the route of an appeal under s204 of housing act 1996 because if it goes against them they could face costs of both sides and this could be as much as £8,000.
I Beleive mot should speak to Shelter to find out why they feel that their assistance will be detrimental and if they can help with everything other than the final appearance,
