It may just mean that they paid out the small sum as that was cheaper than them actually going to court.
However from a customer services perspective they should have issued a new gift card, but I don't think leagally they had to do anything.0 -

I took it to court - If they wanted to settle it would have cost them only £30.00,. Now they are settling through Court at a cost of £61.30.
They incorrectly told me there was an expiry date on the back and when I said it didn't , they referred to their legal team where they decided to await my court claim - which I warned them I would do. They now have to pay double that, plus incurring the fees of someone at their legal department looking into it again! We all know how much legal costs are.....
Please don't be negative. I only asked for a fair hearing from them - right or wrong (and in this case they have admitted their error) there is no reason to feel that you can't ask for something more than they think is fair. Initially I advised I only wanted them to offset the card values against the purchase I presented them at - the undated / no expiry dated cards . Is that so unreasonable??0 -
You actually went to court? It seems very quick to have this case heard and decided in such a small period of time.
On their legal costs they will employ their own in house Legal department so it won't cost JD sports anything internally to have someone from their legal department look at this for them. I imagine they didn't spend long on it.0 -
Can the OP prove they went to court please.0

If my word isn't good enough, sorry.0 -
By the way - in the terms and conditions of gift cards - with JD Sports - it does say the reserve the right to amend, and waive the terms and conditions - so there is always a path to negotiate.0

I applied last week and JD Sports have today E Mailed me asking to settle this by refunding me the amount of the claim and writing to Court to stop the action. They also want me to disclose my card details online, contrary to their initial stance which advised they could not accept my card details as it was not secure to do so. I am waiting for their written response as so far the E Mail is my only confirmation of their proposal. I did tell them I had issued Court procedings and they still declined to show any kindness. They could have settled on an ex gratia basis for half the cost - a gesture of goodwill. A phrase not used enough these days. I am just a parent who wants to keep their costs under control. I didn't disrespect them on Facebook or Twitter which I could have done. I shared it here hoping for some sympathy but I seem to have received critical hostilities.
This makes more sense. Well done on your win.
Most big companies can't be bothered going to court for things like this so for a small amount of money will probably settle.
Although in this case its cost them more money in the long term it probably saves them money as many people won't go to court over this. So in your case they have to pay £60 but for another 10 consumers they won't refund the £30 and those people won't go to court0 -
You might have issued court proceedings which cost £30 and then they would have just paid it including the court costs.
But you didn't actually attend a court as it didn't get that far. No judge would have looked at your case as JD settled when you sent papers.0 -

I did say Small claims court - never mind no judge looking at it - it would have cost a fortune. But thanks for your well wishes.0
