With regards to my mum, on numerous times she would come in with me and after 15 mins I had to put her back in the car.
I continued to do her shopping and maybe an hour later I would get back to the car. So I was doing the shopping , she was sitting in the car all alone in a disabled bay?
Surely according to the comments here, I was abusing the space

No, you were not abusing the space in that scenario because she could not leave/drive and was perfectly entitled to go about her business, even briefly, from that disabled bay then return to the car before you. And sit there and wait for you, that is reasonable.

Entirely different than a relative rocking up with a 'token' disabled person sat in a car in order to bag the best space - to put it bluntly.

because the BB scheme makes no distinction or caveats on where the misuse can occur, just if it is misused (I suppose it could be considered to be fraud which can occur on private or public land) then it is a criminal offence , so as theft on private land or from shops is a criminal offence so I see no reason why this could not be a criminal offence no matter where it occurs

the BB booklet does state that the rules on private land must be checked and followed

the judge clearly thought it of no consequence to the case and presumably thought the judgment in itself was punishment enough

ps:- my local hospital has a police presence and I myself have had my badge checked by a police officer, on private land, at the NHS hospital (on trust land)

so they can and do check for misuse by the public, even on private land

had misuse occurred, I am in no doubt that they would have impounded the badge and possibly issued a prosecution , plus reported me to social services

The Police would have no interest, with respect, they do not have the finances to catch many crimes (that are real), what interest would they have in a lady taking her dad out for the day, popping into Asda, parking in a disabled bay then her dad did a walkabout because he is ill, should I complain to the police because I think someone stole a newt from my garden pond ?

Just a thought. Everyone seems to be making an assumption that the judge has ruled about the misuse of the BB badge.

If that was the case I would have thought that should have been explained to the OP at court, and he/she would have paid up 'happily'.

Without seeing the judgement we won't know the true reason for the verdict. It could be the verdict was due to 'no badge was visible', which might open another can of worms.

I don't think the Judge ruled on misuse of a BB - she could not. This was about contract law and sounds like it was defended weakly, as so many are (but it being Devere on 'home' turf, chances are any consumer defence was likely to fail).

Wibby8888, did you get any impression of...BIAS?
