    If he is named then he will have PR and will need to consent, regardless of his role in the child's life. :(
    yes he is, i have said my son has his name which he couldnt do unless he was on the birth certificate.

    I agree with that.

    I'm in the same boat except I know where he is and he's just being pig awkward and refusing everything to spite me, rather than think of the childrens welfare and wishes - grrr!

    Your son can legally be given any surname when first registered, regardless of whether the father is named on the birth certificate or not. :confused: Your name could be Miss Smith, the father's could be Mr Jones and you could register the baby as Elvis Presley (if you had wanted to!)
  • Just thought I'd say that I always thought you needed to pay for a name change ie Deed Poll etc, and I in fact paid to have mine reverted to maiden. It was only a couple of months ago I found out that you don't need to pay as you do not need the services of a company or solicitor etc in order to LEGALLY change it permanently.

    I also discovered that contrary to all the misleading information on the web (including advise on solicitor's sites and help organisations) it is legal to change your child's name for the purposes of school, gp etc without consent of an absent parent. I don't say it is right and I am sure morally it is questionable however it is nevertheless quite legal to do so.

    If you'd like me to send you the template Statutory Declaration and supporting letter that I used (my children now have bank accounts in their surname which is now the same as me ie my maiden name), please pm me.

    For me there was no crisis of conscience as I was always known by my maiden name through my previous marriage and the children have always been appointed my surname throughout school. Their father (my ex husband)declared a few years ago that he wanted nothing more to do with them and has been true to his word.

  • Iv been thinking of changing my name, adding my OHs surname to my original name. i have a copy of the deed template above, should i bother getting the deed signed by a solicitor or just get a friend to do it for free? I've checked on the DVLAs website and there would be no charge for me to change my name there but theres a large fee on changing the name on my passport (about £60) and i cant realy afford to pay that much out as iv only had my passport for a year, could i still use my passport with my old name on it at airports or as ID?????

    As a woman is entitled to change her name on marriage to that of her husband, producing your marriage certificate is sufficient for evidence of that change should it be required.

    The only effect it will have is that it will no longer be the only document you will be asked to produce to prove your change of name. That document is evidence of your change of surname. You will undoubtedly need a document to prove your change of first name as well.

    ooo-idont really know where to post this-think i need a legal eagle.
    I changed my name back to my maiden name some time after I divorced.My solicitor drew up a document.This has sufficed so far.I am re marrying abroad and all the things i have read seem to be suggesting i need a deed poll document,if they wont accept my current document ,how long is this likely to take-I am getting really stressed!
