£100 fine for no Mot.....worth taking to court???

All the scaremongering posts by beamerguy regarding motor insurance being void/invalid as a result of the MOT having run out are misinformation here and incorrect.
(The £100 fixed penalty is the norm for being caught with no MOT.)0 -
I have just checked my V11 reminder from feb 2016 and insurance is not mentioned on it at all !! nada , zilch
(except for that warning about all vehicles needing it)
so whenever they changed it , its some time ago
my old MOT cerificates also listed a system where you paid an extra £1.50 and they issued an MOT reminder by text
but my missus says the system we use is better, a yearly calendar with all the important dates listed, including renewals , which she says are £1 from the "pound shop"0 -

Hardly, do check with your insurer first, or try and get a quote stating no MOT
Last time I had a look, there were still some major insurers that didn't have a requirement for a valid MOT in their small print - A number of companies that accounted for approx 40% of the UK market at the time.
The rest did - although even then, their T&Cs cannot overrule an FSA decision. So they would still be obliged to provide RTA-only cover in the event of a customer being caught. Until they voided it at least but that would be after the fact.0 -
how could you rebuild / repair a car over many yrs and take it for its MOT , I have never been asked for MOT details when insuring a carSave a Rachael

having just read my sons latest V11 I agree with you, but I know that in the past it was a requirement to have the insurance document to tax a vehicle
this latest V11 simply states the following
THIS VEHICLE NEEDS AN APPROPRIATE MOT TEST CERTIFICATE
there is no mention of a valid insurance certificate, as most of you are saying, therefore that requirement is no more, end of argument
With all due respect Redx, I have just renewed my road tax for 12 months.
The V11 is outdated in terms of requirements and charges.
However, when renewing car tax, the system clearly checks with the insurance data base that the car is insured,

When I renewed mine, it showed that the tax was overdue despite me paying.
It can take up to 7 days to show,
I asked a police officer about this and he went onto his system in his car that still showed my car was not taxed but it showed the car was insured. Two days after it showed my car was taxed.
As the police said to me, if there is no insurance it cannot be taxed
It is now a cross reference data base which is electronic0 -

But they are just trying it on - naive customers might accept it if (eg) Axa write and tell them to look at condition xx in their policy to see why their claim has been rejected.
But the FOS has ruled that such conditions cannot be used, and are meaningless.
The only downside to having no MOT (insurance wise) is that it affects the market value of your car - thus following a write off, the value of a car with no MOT is less than a similar model with an MOT.0 -
so the guy at the DVLA was telling me lies , and I should not have been able to register and tax a bike without insurance

It is quite normal for there to be a delay on the MID database ,
scenario : car on drive , ring insurance at 10am , and wait 3-4 days for it to appear on database?

Agreed, trouble is, how many people know what the FSA state and how many would query when an insurance company says "you did not have a valid MOT"0 -
