    I figure if I mentioned there was no NTK then they could say that they sent one, knock it up and produce a 'copy'. Am I over thinking this?
    I doubt they would but they might.

    They are more likely to try to tell a Judge that they are assuming you were the driver as you appealed a windscreen PCN. It is not necessarily the case that a keeper was the driver but they will try to say you must have been driving, because then the POFA and NTKs do not matter.

    The keeper was at work about 8 miles away and cycles there each day. They have no access to emails outside of work so can prove they weren't driving. Also, copious witnesses who saw them at work.

    The appeal was done in the name of the keeper - it gave the option for keeper or driver or I think also 3rd party.
