OK then. That will help. If you could provide copies of other letters/applications that he's received since 2012 that'd also help. One letter from 2012 is not enough evidence. Not on the face of their own website information:

Which clearly states: "Your income may affect your income-related or contribution-based ESA. Income can include:
you and your partner’s income
savings over £6,000
pension income
You won’t qualify for income-related ESA if you have savings over £16,000."0 -
hang on a second? do they expect people with LD to go looking for this information, if they are not computer lit?

also previous years on award letters never mentions anything about savings... its just a basic letter.. for each year..
but has stated it deffineltly states you or your partner or you and your partner 16,000 nothing at all about the 6k threshold0 -
As I have said on the Yourable forum you are going to have to wait and see what the Decision Maker says.
It is absolutely pointless getting so worked up about it. You are just wasting energy.
Your friend is in a system which is using tax payer's money and there are rules which have to be adhered to. Your friend is just a name on a piece of paper/computer.
Your friend should have an appointee if he is unable to manage his financial affairs.
I accept that they have made mistakes. If they say he has an overpayment then he will have the right to appeal.
We all know the system is flawed but concentrate your efforts on reassuring your friend that a decision will be made and you will help him appeal if necessary. Get some help from CAB if needed.0 -

The point I am making is that this information is very accessible. ONE letter from 2012 isn't going to help your friend prove that he's been misled by the DWP. He needs more evidence than this.

Presumably he had a means tested element to his incapacity benefit, who completed the paperwork for this? Has he never had a benefit review form, which would ask for details of capital, property ownership etc?0

To post the letter you need to go to photobucket or similar, upload the picture to there and put a link in this thread.Unless I say otherwise 'you' means the general you not you specifically.0

Can yourself or the advocate worker access any further support for him? Last year I was being hounded for a housing benefit overpayment.., admin error on their part, I didn't receive the letter informing me of the overpayment in time to appeal, and it was a mistake on their part because they didn't act on information I gave them.
I phoned, was told the money had to be paid back regardless, there were never strike offs etc (the money they said was owed wouldn't be written off). One letter from a social worker saying that I was in a bad way at the time and I received a letter saying the overpayment was written off.
I agree that someone with such a low IQ cannot be expected to understand such things easily (god knows the most intelligent of us can have problems). I wonder if someone can write a letter (social worker or something). There should be a vulnerable adult team at your local council?0 -

Well, produce it to the DWP and use "misdirection" as the argument.0
