The figures I worked on affordability were based on the mpg figures he told me.

So you're out an extra tenner a week odd on diesel and from your own words thats causing you "great financial hardship and stress"?

Sounds like you cant afford the car and are looking a way out.

I get that he probably went off of the official ones but its still a lie. Surely the honest answer would have been to say that he couldn't guarantee it. That's the point I would have walked away from the sale.

No salesman in the world ever is going to guarantee the exact MPG of the car. No doubt though they used terms like "is capable of", or "up to".

I am also very impressed with several posters own innate belief they can make any judgement they see fit on another human being based on a post on a forum. Go take a look at yourselves.

You've moved the MPG you're getting from 50mpg to 43mpg and now 39mpg in order to justify your stance.

You were told in post 1 you've no recourse against the dealership unless you got it in writing that you were going to get 70mpg and they simply wont have done that (nor guaranteed you it)

I'll take this question back to somebody with qualifications and a bit of decency and won't be making the mistake of asking a question on here again. I'm sure it's lovely in your closed community circle jerk but unfortunately I'll have to pass.

Well when someone how has the "qualifications" - presumably a solicitor @ £200 an hour - then feel free to back and confirm what i / we have been saying.

    But i doubt you will

    Usual forum story .
Poster believes they heard salesman say X and now salesman denies saying X .
Poster comes on here to basically demand the forum backs up their viewpoint .
Forum does not and OP gets on high horse .

Me sold cars when this fuel stuff was first plastered on the screen and it was always up to x mpg and sales staff where careful to not say these are anything but test results .

Partly true. I agree that OP isn't being realistic. Even modern cars take some time to get into their optimum running both in performance and economy. I think the OP was more than a little naïve in taking the word of a commissions based salesman at his (unwritten) word.

The other part where this forum is being true to form is in the way that Bigji and others get into their school bully routine and accuse anyone who disagrees with them of being Dark Matter under another guise like their opinion is the only one. For Heck's sake Grow the heck up Bigji and co.

I've said this before and admin should really be saying this but as usual they are disinterested and would rather leave a few school bullies run the show. If you think someone is posting under multiple names or trolling report it and see what they do. It's childish to go around throwing around accusations and actually makes you look like creatures who belong under a bridge.

Just because you think allowing the forum to be ruined by DM and other trolls doesn't mean everybody else should accept it.

You seem to be the one throwing insults like a "school bully".

What you have basically said is leave trolls and DM to Admin but Admin do nothing.

But you seem happy to be singling me out though!

Why didn't you leave it to Admin??????

    I feel harassed.

    Boo hoo.

I think I see the problem here............

    Buyer trusted a salesman.

Appears to be a bee in their bonnet, they have already had a thread in Site Feedback on the same subject and had a reply from MSE Andrea there.

So true. If the salesman says: "Lovely day today." to you, then look outside to check for yourself.

Next point is that you have to be gullible to think that any vehicle will achieve the published MPG. Very very few people with abnormal driving styles and commutes will achieve that.

In my experience, in the congested South East, you can lop 25% off any petrol car MPG, 40% off a diesel car and 40-60% off a hybrid MPG.

Finally a SUV will have a much larger frontal area than a small city car. Whilst a city car has a fighting chance of getting close to 70mpg, a SUV will never achieve that. I'm fairly sure that the MPG tests are performed on an enclosed rolling road and do not properly take into account wind resistance.

I'm paying a couple hundred pounds in diesel money a month, not a paltry amount. I also couldn't do any real mpg research on the vehicle before hand as it was a new model Kadjar. I got the first one to be sold by that dealership. I said it has never achieved 50mpg, it actually gets around 43 on the extra urban cycle.
It has an eco meter that measures your driving style and even in the high 90% it still doesn't do over 50mpg.

I'm aware the advertised figures are lies but I didn't take my figures from the adverts, I was told them by the salesmen in the dealership I would get up to and around 70mpg on my commute. This would have made the car a damn site cheaper per month.

The salesman has to take what the manufacturer quotes as fact, like your gp telling you a harmfull drug is harmless because he can only go on the information he has been given by the manufacturer, the salesman is just a salesman and not a statistician or fuel economy specialist, can you prove he intentionally misled you and lied? nope, thought not
