Change back to maiden name without consent

    To change your name, you need to prove the names as in with Birth Certificates, Marrriage Certificates, Decree Absolute etc but you don't need anyone's permission. Even if you were still married, you could change your name without having to ask permission.

    on page 5 of the guide for adults it goes on to give a checklist for the statutory declaration..

    Ensure all relevant documents are exhibited and attached
    (Copy of citizenship, marriage certificate and letter of consent
    from partner if applicable).

    According to the site I read, you have to execute a Deed Poll to revert back to your maiden name but they wouldn't require your husband's permission.

    You have to go on the download section on the 1st link and then lots of forms come up and the first one is the guidance where i saw it on page 1 and page 5.

    Wow, I stand corrected! For all others reading, extract from the links:

    No way would I have been asking my then-husband if I would have wanted to change my name whilst still married. You may be married to them but they don't bloody own you!

    Ok, i will just try without it i think.

    I just thought i would use the .GOV site as it would def be the most official and credible one!

    Thought i couldn't go wrong...!! Haha!

    I went into my GP.. filled out their A5 form on the desk for changes.. changed my name there and then so I didnt have to have the ex's name on the baby's birth certificate.. The bank I just called and that was changed with immediate effect... I used the birth cert, medical card and bank statement for anything else i wanted changing .. all in all it took about 3 weeks.. no paperwork needed from anywhere!

    You can call yourself whatever you like!

    You've been seperated for two years, but are you legally divorced? Surely if you're legally divorced then you're not married therefore you don't need our husbands consent because he's not your husband.

    I was also under the impression that if a woman was married it was up to her whether she wanted to go by her maiden name or partners name (or combo of both?) you just need the marriage certificate as evidence.

    So surely it should work the same way in reverse? The marriage certificate also proves your maiden name, therefore you should be able to just use that to change your name back.


    I also think it seems completely insane that you should need a letter of written consent from your husband to change your name...it's your name! Married or not your name should be YOUR business!
