Change back to maiden name without consent

Hi

I am have been separated for 2 years now and i would like to change my name by deed poll ASAP (I am graduating soon and i'd really like my own surname on there not his I also need to apply for a new passport as mine has expired and don't want to pay twice!)

I have been on the .gov website and it says i need a letter from my husband to give consent..

I have tried to contact him (EXOH) but have had no response.

I raised a query ticket with the website and their response was that they were 'unable to answer my question as they are only a general information website'.

Does anyone know if i can still go ahead seeing as i cant seem to contact him? Or whom i should contact to find out??

    your maiden name is your name always.. if you want to use it, it is yours, use it.. you don't need to change by deed poll or anything else and you sure as hell don't need anyones permission!


    you need permission to change your childs name.. maybe you were reading the wrong bit?

    You don't need to go down the deedpoll route to take your maiden name back, you still own it, you never lose your maiden name and are free to revert to it as and when you see fit.

    Really? The banks etc say they want a copy of divorce papers?
    This was on the HMC guide.. As did the people at student services at uni..

    Whose permission do I need?
    If you are married you need the written consent of your
    husband or wife. If you are a minor (under the age of
    18) then you need the written consent from all of those
    people who have ‘Parental Responsibility’ for you

    Could you post a link to the page you read that on?
    I think you must have stumbled on to the wrong page somewhere as you certainly don't need your ex-husbands permission to change your name, it's not the 1950's :eek:

    I separated from my hubby one day, the next day I stated using my maiden name. Was simple?

    It's my name, I don't see the issue? I let the passport run out, but changed bank etc with birth certificate, to be honest I don't think I even used that, but can't remember.
    Forty and fabulous, well that's what my cards say....

    When a marriage comes to an end, many women wish to revert to their original name or at least alter their current name in some way. If, upon marriage a woman simply adopted her husbands surname she can use her decree absolute to revert to her maiden name. However, if any other name change was carried out a Deed Poll will be necessary.
    If a woman decides to revert to her maiden name prior to her divorce being finalised and before receiving her decree absolute she has every right to do so. Many women are under the false impression that when they begin divorce proceedings, they must use their husband's name (if they have taken it upon marriage) until the divorce has been finalised. This is not the case.
    A separated woman can change her surname at any time by Deed Poll. She may be making simply reverting to her maiden name, or could be altering other parts of her name. No matter what kind of name change is required a Deed Poll can be used to get all records updated quickly into the new name.

    But that's about changing your name which isn't what you're trying to do. You just want to go back to using your own name which you've never lost.
