  • Who owns the road?
    If Persimmon, what does your lease say about the road?
    Perhaps Persimmon can refuse access to Taylor Wimpy across their private road, and maybe you can persuade/make them do this.

    I am not feeling too hopeful though - presumably Persimmon have had to not build the house that was planned for the end of the cul-de-sac, in order to leave it open as a through road. They must have had some reason (money?) to do Taylor Wimpy such a favour!

    Here is a link on the Taylor Wimpy website (I can't post a link) and the development is called Leighton Buzzard Off Grovebury Road

    We have read through our searches and we are all still very unclear as it starts that a development was approved for Taylor wimpy to build 400 and something new homes BUT they already have 2 sites that are called the same thing and are to the right of us so we thought that that meant those ones, it is all very unclear and sneaky. This development is quite a way away and if on the left of us.

    It's not sneaky. There would have been a location plan submitted with the Outline Application, to show exactly which plot of land it referred to.

    Yes of course we all did, but it was mainly Taylor Wimpy showcasing their amazing plans and handing out packs. There were forms to fill in to air out views and of course we filled them in but did not know where we stood when it came to their plans.

    Looks like TW have gone through the process once with the outline application, and you're at the "local authority publicises and consults on application" stage of the full application.

    It looks like a former brickyard surrounded by industrial estates on three sides. I'd say it was the kind of site that was a rip-roaring certainty to be developed some time real soon, and that access was always going to be from the south if the development was residential.

    Thank you that is very helpful. We did attend yesterday but like I said below it was mainly a showcase for Taylor Wimpy and I think we need to write to the council with our discrepancies about the site entrance being where it is.

    But why is the access from the south? There are so many other access points that would make more sense
    -Grovebury Road there is already access BUT is only going to be used for buses and cyclist
    - Chartmoor Road
    -The A146?

    Yes, write to the Council's Planning Dept and then when the detailed plans are submitted you can write again in respect of that particular application. You will almost certainly be invited to do so anyway, by the Planning Dept, although this may not be in the form of a personal letter but could be a notice in the local press or a notice pinned up at or near the site.

    Because the south is residential.

    I'm just looking at it and seeing a housing estate that's being proposed in the middle of an industrial estate. People don't want to buy houses in the middle of an industrial estate so, obviously the developers will go to some efforts to disguise this fact. Like landscaping the site to hide the 'industrial' bits, and ensuring that access is only via the residential south, and thus the perception will be that it becomes an extension of that residential development.

    So, just to be sure I've got this right...

    You bought a new-build house in 2015, and are complaining that you've been "mis-sold" on the basis that the developer didn't tell you about somebody else's outline permission granted in 2011...?
