    Well.. not yet anyway. I expect that's something Nicola would quite like to discuss in her meetings with Junker and Barnier tomorrow though.

    I’m not sure threatening to take action against Irish fishermen is going to help Scotland’s case.
    Ministers said they received a letter from Fiona Hyslop, Scotland's Cabinet Secretary for External Affairs, stating that vessels will be deployed to take "enforcement action" against Irish vessels found fishing within 12 miles of Rockall from last weekend onwards.

    They certainly will. And I'm sure they'll be wanting to keep a piece of that Scottish Fishing waters action too. Something I'm sure Nicola will be pointing out behind the scenes today. As well as sounding out how supportive certain members would be in the ( almost 100% possibility now ).. in the event of a vote in Scotand sans a Section 30... but perfectly legal since referendum legislation has now been deemed within Holyrood competence. Just the question and date to sort out.


    Because lets face it, even the most hardened unionist people and newspaper columnists in Scotland can now see that Boris as PM is likely the end of the UK. The run up is only the pre-show ads.. and they're bad enough.

    Yes you can have a second referendum without Westminster authority but it would be without legislative competence. In fact it would be about as legitimate as the Catalonian referendum. Do you really want to waste your efforts on a pointless referendum?

    The Referendum Bill for all referendums held in Scotland, has been deemed within competence by the Presiding Officer and the Advocate General...
    As it is framed, this referendums bill is clearly within the competence of Holyrood and cannot be challenged as dealing with matters reserved to Westminster

    Referendums aren't reserved to Westminster.
    ...having established a general framework for the holding of referendums the bill authorises Scottish ministers to proceed with a referendum subject only to a majority vote in Holyrood.

    That’s significant because decisions by Scottish ministers which Westminster objects to are not liable to immediate transferral to the UK Supreme Court.
    Objections to ministerial decisions have to be dealt with by the Scottish courts and make their way through the Scottish legal system.
    In short referendums in general are unquestionably within Holyrood's remit and the framework legislation is beyond reproach.

    The political decision and vote in the Scottish Parliament can of course be challenged. But any challenge will have to start via the Scottish courts and legal system. In other words a second indy ref only needs one majority vote in Holyrood to go ahead... and it won't be the legislation Westminster will be challenging. It'll be a political decision taken in the Scottish Parliament itself.

    Grasp this concept now. take it in, digest it and understand it.. .For all talk about legal referendums in terms of legislation has changed and it's time you caught up. The next UK PM won't be challenging referendum legislation or any lack of a section 30. But instead will be challenging, via Scottish courts, the very rights of the Scottish Parliament to ask it's own Scottish electorate a question.
    It all seems so stupid it makes me want to give up.

    So we could have a referendum.

    If we have the same voter turnout as the European elections just under 40% with 51% of those backing Interdependence - would that be enough to drag us out of the UK?
