Dealer sold an unroadworthy car

    Hi, cheers for all the replies

    Sorry things seem muddled, I didn't know she was picking up the car until she came back with it..she knows little about cars, but wanted a bigger car as she is expecting a baby soon and her older one was becoming less reliable

    I understand the mechanic that looked it over, advised her to try for a refund as it "could cost thousands" to fix, I'll try get a copy of that report to have a look, but briefly Ive been told it has 3 code faults.. (I admit, not sure what that means"

    I also said to her about the battery, and apparently the seller said they didn't realised the battery was an issue until my sister had gone to pick it up, they then charged the battery and deducted the price of a battery off the sale price.

    Personally, this would have put me off, the lack of service would have put me off too, and I understand all of that

    But it was me that told her I think she had a case in court if it went that far, as I understood the car should match the description, its described as "running well" yet 1 week or so later its considered unroadworthy.

    she has been in touch with seller via ebay, and Citizens advice, so just waiting now, and ill post the report when I get to see it myself shortly.

    The seller was has several vehicles for sale and the invoice has a company name on it, but I cant find anything on that name under google or when I search either of the phone number supplied, so I am going to have a look online now about that.

    To be realistic just because one garage says a car needs a lot of work it doesn't necessarily follow that it is not as described.

    I had a Citroen C3 and I loved it, but it started to develop an issue with a light coming on and Citroen told me that that something or other was seriously wrong with the car and it was unroadworthy and they quoted me £1600 to fix it. I happened to be in Kwik Fit to get a tyre changed and mentioned this code fault, they told me they would have a quick look as my model had an issue with a water drip that sometimes triggered the warning when nothing was actually wrong. They spent 10 minutes under the hood, warning light went off and they said it was a completely free repair as all they did was move a plastic widget from X to y. Yet according to Citroen that 6 year old car with full Citroen service log was dangerous and not roadworthy.

    Incidentally I part exchanged that car at another Citroen garage within a few months , their quick report gave me a very good trade in price as they said they car was in excellent running order.

    their description "Car runs & drives as it should" I thought is wrong though, as it doesn't. Infact it took the mechanic ages to get it to even start when she took it there and left the keys for him in the morning

    But, seller has contacted my sister and asked for her phone number so Ill update what is said next

    where does it say the trader was listing as private?
    Also we are yet to see what is supposed to be wrong with the car.

    I looked at the listing-it wasn't a business account , but op didn't purchase through eBay.

    Whilst they should have a business account,it doesnt stop the seller being a trader and selling as a business.
    Same as folks can have an ebay business account without having a business.

    The seller got back on touch with my sister and so fsr they seem pretty decent about things

    They've offered her to trade for another vehicle.

    I think my sister will await confirmation from citizens advice as advised by trading standards before she decides. They are getting their mechanic to look at the car and to arrange transport of it

    You're right it is a personal account

    The receipt had a trade name on it, I don't wsnt to name names or anything so that's why I didn't post the ad itself.

    I find it odd personally that both numbers provided are mobile numbers snd I can't find any info on the company based on its name . No website or anytjig

    I am going to guess she was happy with it when she saw it and took it for a test drive, did it come with mot or warranty? Unfortunately i think she will have a fight on her hands.
    hope she get's it sorted.

    What on Earth has that got to do with the OP's sister's consumer rights?

    you have the result you need if your sister is happy with the resolution
    it might be a while before c/a get back in touch and they will basically advise what selling dealer has offered,if you get too forceful then as i mentioned selling dealer could argue battery fitter miss fitted battery thus causing body control module issues and it would go to resolution if both parties agreed and if that fails court and even with a report from independant garage that fitted battery it would be argued they mis fitted the battery
    im talking from my perspective here as if it were i as selling dealer

    to custardy by selling cars under a private account it is an offense because the traders name and address need to be shown in case it is needed to say deliver an lba,trading standards at one time would pursue this as its unfair trading practice,ebay should make all trade sellers show their full details just like i have to so then we would have a level playing field, hopefully once we leave the european union we can stop this company based in Luxembourg from trampling on our laws and ignoring requests to insist trade sellers show full details

    Thanks, yes I told her to call rather than email tomorrow too

    I unterstand what you mean regarding the seller could claim the battery bot getting fitted properly. Though their advert doesn't mention battery issues only verbal and mechanic checked over it after that and apparently what's all fine, but I understand your point completely.
