    That is a surprising result. Perhaps there was some other info on the buyer which you weren't privy to (they'd perhaps done similar before).

    Do make sure you get the refund. Ebay do have a habit of saying one thing and doing another.

    It was difficult to follow your thread as you seemed to be jumping the gun on lots of points - court action - when actually that expense could have been avoided.

    Just be mindful to keep everything in hard copy. The buyer may still be able to convince Paypal to chargeback the payment.

    You can see how PayPal has ended up much bigger than planned, and will operate like a normal bank and require merchants to put x amount of transactions their way, eBay will loose their payment facility for occasional sellers, and then eBay will become only for bigger merchants too.

    So on ebay's website, the case shows up " Good news - we reviewed your case again, and we refunded to your original payment method.
    Just allow up to 48 hours to receive the refund."

    I will give them another day to pay me since it's only been 24 hours.

    Sorry if it was hard to follow, I tried not to. And yes, I keep the trigger pulled on the court too. I will ask for a few hundred pounds for the hussle and everything else she caused.

    I take this as a necessary loss for a greater reward. Now I have got the right to take her to court plus I can claim some extra money off her because of what she tried to do.

    I'll come back here once I got the payment, but I'm happy to update you guys on how the court goes too:-)

    What are you taking her to court for? You haven't suffered a loss (other than of your own making) that I can see.

    I really think you should let this drop now,you're starting to come across as nothing more than a money grabber.

    You are being refunded so have no loss other than the court fees which you started very hastily.

    You cannot change the first claim to anything else ie fraud or libel so that money is lost.In fact I believe it was you who actually posted the buyers name on this site with the suggestion to look on you tube for the video of her opening the package.

    Anyone can take another person to court(more expense) but there is no guarantee you would win and even if you did no guarantee of any payment.

    Really,appreciate the fact you have got a refund and move on.

    You can't get the money twice, from ebay and via the courts. You just can't. You can't get damages for libel/offence through small claims. You just can't. It's for demonstrably quantifiable losses only. Not 'butthurt', but where invoices are unpaid, a paper trail, etc., to restore you to the same position as before the disagreement.

    Libel is an entirely different thing, don't even start on this path unless you've got £10k for legal costs AND the other party has the money to pay you damages.

    What's he gonna say in court? Small claims courts , which is what he said he filed, aren't there to decide on his hurt feelings. Ebay have refunded his loss within a few days from what I can see , well before any LBA would have run out.

    The police aren't going to bother with something like this as they'd never be able to prove she'd 'stolen' the phone could well have been switched by postie so that'd also scupper his libel case, if he could even afford to take one out. If anything she'd have a better case for libel if she wished to pursue it.

    At the end of the day you've had a result getting your money back ,, I doubt many in the same situation would be as lucky. Block the phone and move on, that's likely to be being used abroad by her relatives by now :0
