    I can't see how you have opened a case against the buyer as the only case a seller can open is unpaid item,unless you mean you have reported her for abusing the MBG?

    Also I don't think ebay allow an appeal or counterclaim while you have another claim in motion(Small Claims Court)though a Crime Reference Number from Police or ActionFraud may help.

    As for the £60.00 Court fees ebay wont be interested in this and will not force/take a payment from the buyer.

    It is still possible ebay may issue a no fault refund to the buyer and you keep the payment but you still wont get the court fee or the iPhone 6S Plus returned.

    Guys! I have just appealed the decision and spoke to ebay twice and they will get me a refund by tomorrow!!! Isn't that great?! At least there is a way to win!

    Thanks for the help everyone, I will still take her to court for libel and trying to commit fraud.

    Glad it's all worked out but you need very deep pockets to sue for libel and I don't think it would be your decisions to prosecute for fraud.

    Take your money and enjoy it and draw a line under this whole affair.

    Yeah I would but now I paid in£60 for the court fees. At least I wanna get that back!:-) I would be even happy if she would end up getting prosecuted for trying to scam me.

    What can you supply in the way of proof of that? Have you got a recording? You seem to record everything...so?
