    There is no point posting anything from citizens advice, The OP doesn't seem to think they are capable of helping people. I tried to post a link about PIP.

    So since the OP seems to like your post, This invalids there entire though process of just getting a lawyer to do it all.

    Parliament has set the rules up! Parliament has decided people can the help as I listed taken from Scottish Legal Aid Board. Thought you were not happy I was accessing something that I can by LAW. But yeah myself and those whom seek professional help as provided by law are abusing the system! Get a grip. Plus if the Solicitor thought I had no case he would refuse it. The frst interview is what Scottish Legal Aid call diagnostic.

    I know that! You have created so much a of a stink I hope a moderator comes because all I have done is put to the forum a question then you open it up about appealing . Say you know it and I could not get help then now you accuse me of scamming ! You seem not to know about the Scottish Legal Aid Board . If you don't like the system mail your MSP. I stated I wanted to get reports done to PREVENT me having to appeal. Prevent.......

    A stupid lawyer lol. What because I asked about my options should my PIP claim be refused? You ave made a hell of assumptions of what I have done or not done!

    NO assumptions, Just going by what you have said, You seem to lose track in what you say. Maybe you could use this in your "How your disability affects you" form.

    Why do you think you will be refused? You are acting like an immature kid, And going by your previous posts on other threads I suspect you are a person of older age, Since the DHSS ceased to exist in 1988.

    I will tell you about the options when your PIP is refused.

    You get a letter explaining why you didn't get enough points, You then either write a letter or phone DWP to request a mandatory reconsideration, If they don't change the decision you then get a appeal form from DWP and you send this to the court who will inform DWP you wish to appeal.

    And all reports regarding your health are sent when you send back the "How your disability affects you" form. Which you can obtain letters etc from your GP and any specialists, Sometimes GP ask for a admin fee of like £10.

    So I do not understand the need for this legal aid board!

    Ok bit confused but just to clarify you are going to use legal aid to get a report from a physiatrist to send with your Pip form is that what you are trying to say ?

    No. My own money. Somebody on the thread has taken issue with me using Legal Aid should I be rejected. So if I get refused they rather I use Citizen Advice. Where as I can in Scotland use a Solicitor. He/she has taken issue and cited how much it costs and basically I am abusing the system! Yet the Scottish Parliament has said people can use it to challenge social security matters.

    I want to use my OWN money to get the report to fingers crossed prevent this happening. As you know GPs etc are refusing to provide letters etc.

    Forum is about accessing what you can be law yet this person is throwing her toys out the pram as she/he does not like it. Seriously! I would not be using Legal Aid unless they knock me back again the poster can't grasp that. Thinking I will use it to make the application for PIP!

    So since the OP seems to like your post, This invalids there entire though process of just getting a lawyer to do it all.

    To be honest I quoted that link for anybody who has been following this thread who may have an interest in applying for legal aid in Scotland. I am a little surprised that on a forum run by MSE how much incorrect and/or confusing information is given out. Not picking on any individuals - just a general observation.

    I have to say that I have lost the thread on this thread, though!

    I feel Bryando made his/her position clear at the start, someone muddied the waters and then paragon909 picked up on the incorrect assumption, made by whoever muddied the waters.

    Bryando was not talking about appealing and only replied re- using legal aid if he/she needed to. If legal aid is available for that purpose in Scotland then good on Scotland because the devastation that this change over to PIP is having on genuine disabled people is a disgrace and those in the UK do not have recourse to legal aid for appealing DWP decisions.

    I know many people are very, very worried about their PIP applications and many of those have not received them yet, but the waiting is taking its toll. There is nothing wrong in planning strategies for what ifs, in my opinion, and with the way things are going it is best that people due to change over to PIP do so.

    Many disabled people who had HR in both components of DLA have lost them completely under the PIP system. Some of these people were almost unconcerned and sure that they would, due to their disabilities, have no problems.

    I know some who have settled for standard care PIP for they are either too stressed out, tired out or afraid to appeal. I personally think the government was banking on this being the case. So if there are people who are up to the fight, then fight and use whatever resources are available to you.

    Bryando mentioned a psychiatrists report and so, and I do not wish to make any assumptions but often those with MH issues will, in most cases, feel not only the anxiety of the upcoming PIP application but also will be dealing with the stress and anxiety that may be a part of their MH issues.
