I would caution against naming anyone on here as this is an open forum and as I'm sure you're husband will warn you defamation is a tricky thing. If this is a 'name' then I wonder if she is just selling off her personal items, or freebies that she might have been given. That would account for her having sold some before and might understand why she seemed so shocked to be told it was a fake.
Apart from the full refund that you have been offered I can't honestly see what else you can achieve here. If you are completely certain of your information and feel strongly enough then contact the actual manufacturer and give them her details. Unless she bought it in good faith, believed it to be a genuine bag and thinks YOU are scamming !!
I personally wouldnt like to be threatened with legal action, but then i dont sell illegal goods, she has handled your complaint totally incorrectly, if you feel all that strongly about it contact trading standards,

inform ebay, they do not tolerate fake items being sold as genuine. They have a procedure for this. Check with them before doing anything.2008 winnings....:)

I'm not surpised you've not heard back from her for a while, after all she is a seller who has offered you an immediate refund and all she's had back is a threatening solicitors letter and some questions about if she can speak English.0 -
Your husband's the solicitor...talk to him. Does he want the hassle? If so why not go for it? If not send it back for a refund!0

You've read my post wrongly there dude, when I told her it was a fake she wasnt shocked at all, her first response was "send it back for a refund I am eager to receive it as I have a waiting list of people to buy the bag"
I would love to name and shame her but hubby already said no :rolleyes: referring to the defamation thing (libel for you guys in england!) plus what if this person has simply hacked into her old ebay account and its not actually her? the seller had previously sold another of the same bag she sold me so she must have a bucketload of them!0 -

She kept replying to my messages repeating that she wants the bag back because she has a waiting list of people to sell it to. I have a pretty good idea she knows it was a fake. Plus if you sent an item in good faith wouldnt you at least apologise? She didnt seem surprised in the least!0 -

Why should she get away with selling me a fake, being so blatant about it and not even bothering to aplogise? If I sold a fake anything I'd be mortified, apologise like hell and offer to pay return postage (infact probably let her keep the item as I can't do anything with a fake as its against the law to sell them) Why should she just be able to say "oh well you realised its a dud, I've wasted your time, give it back and i'll pass it on to some other sucker"?

80% of branded stuff on ebay is fake. that is my view,

about this TV presenter lark, you can use any name to open a paypal account, you can easily get a domain name with any ones name as the Url,
maybe the seller is using the name as a ground of Trust.
or she sares the same name as this other TV presenter,
and based on what the law says you'll have to prove the seller didnt know it was a fake, and that is going to be bloody hard,
so take you refund then think about what your going to do,. i dont think your going to push her to get a REAL bag,
Ebay don't care, £100 they make £3.85, and if you used paypal (ebay owned firm) thats another £3 for payment processing,
and you bought a £290 bag for £100, thinking it was original on ebay, :rolleyes:0
