Bought a fake! Major dilemma!

  • Going back to the OP, was the bag described by its model name or just Mulberry bag? The reason I ask is because in 2 previous threads about Mulberry bags you asked our opinion on a couple of sellers and one of the replies was that most fake Mulberry bags will not mention the actual bag model name as the ebay VeRO program is prety hot on these because Mulberry do not like their bags sold on ebay. Just wondering if you have taken this advice?
  • Is this a TV celebrity or just a TV presenter? the need to Google her name indications she is not well known. I wouldn't be surprised if this presenter turns out to be one who sells stuff on TV shopping channels probably Mulberry bags.

    Yes the bag I bought was described as an "authentic Mulberry XXXXXXXX", ie it stated the actual name of the bag. It was listed as used and it is not a popular bag hence paying only 1/3 of its BN retail value. When it arrived it was quite clearly not the same bag as it arrived BNWT, the leather was a slightly different colour and it was a pretty poor fake. I have bought quite a few bags on ebay and this is the first time I have been stung.

    I know the general consensus on here seems to be that I should pay return postage out of my own pocket, accept a refund and just let the seller sell it again to someone else, but I just don't think thats very fair. Paypal are stating that I have to return the bag to her to get a refund DESPITE me saying its a fake.

    I phoned paypal tonight who said do a paypal claim with them, fax them proof that the bags a fake ie letter from Mulberry and I will get my money back.

    What's wrong with this idea?

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    Well I raised a paypal claim like the paypal agent instructed, then promptly got an email from paypal saying you must return the bag to the seller by 11 sept (trackable method) or you'll lose the claim. Obviously if the seller doesnt dispute that the item is a fake they just let the seller decide on how they choose to refund, obviously she wants the bag back as she has sent me 4 seperate emails saying she plans to sell it on again and could I send the bag back asap to enable her to do so.
  • If she plans to resell on eBay, you could watch out for her listing and report it as a fake when it is relisted.

So instead of us asking you to break the law we ask you to destroy the item.... If the letter is faxed through in the timeframe requested this should suffice.
