Bought a fake! Major dilemma!

Hi,
I bought a fake bag from eBay last week after thinking I'd been very careful, the seller had sold a few other types of bag previously and got good feedback, its not a popular or common bag (such as a Chloe Paddington) and I paid what I believed to be a realistic price for a genuine item.
I received the bag today and its a BIG FAT NASTY FAKE! I emailed the seller whos first response was "return the bag to me for a full refund" no "oh my goodness im so sorry" or nothing! Obviously she knows its fake. My husband is a solicitor and has said since SHE broke the contract she entered into to supply me with a genuine bag I can do an action for specific implement where I sue her for the price of the bag, either she supplies me with a genuine one or I buy one and sue her for the difference.
I emailed her saying this and her response was "As stated on my ebay account you can of course send the bag back within 7 days and I will of course refund the amount. I do have a waiting list so I look forward to receiving the bag.

Herein the plot thinkens! When I looked at her email address I saw it was [EMAIL="firstname@firstnamesurname.co.uk"]firstname@firstnamesurname.co.uk[/EMAIL] so I googled her and apparently shes a tv presenter!:o I emailed her back asking if she was this person (same email addy anyway!) ans she replied with "I have not met someone like you. As i said in my two previous emails...please return the bag and I will refund you as stated.

I replied asking if she could address my concerns and answer my questions (also asked if English was indeed her first language
) and since then she hasnt responded.
Any takers? Should I just accept the refund and be done with it? Or should I push for her getting me a genuine bag as promised? I paid £100 with £12 P&P and the bags RRP is £300.

Send it back with a letter enclosed stating that you want your £112 plus your money it costs to return it.
Send it recorded or special delivery so you get a signature.
Wait for your refund. If you don't resolve it at this point prod your hubby to write a letter.
If your really unhappy give trading standards a quick ring to tell them she is selling fake goods on ebay and her address is ... You have confirmed this by sending the item back via recorded delivery. Do this after you get money back as she'll not have money in prison doing this.
I would not push for real as you might get a better quality fake you can't tell the difference.Lets get this straight. Say my house is worth £100K, it drops £20K and I complain but I should not complain when I actually pay £200K via a mortgage:rolleyes:0 -
It was a mulberry bag, I know them like the back of my hand plus one of my friends works for mulberry and I had her authenticate the bag for me. I KNOW the easy thing to do is just return and refund but dammit I want the bag!!!!!!!!0

No don't send it back as this is how she is getting away with selling fakes! You have the evidence, why should she get away with it? Why not name and shame her on here too.0

My whole point is that I entered into a contract with her for a GENUINE bag and not a fake. She should supply what she advertised. I am assuming that she is the same person because the paypal address is the same as the contact address on this tv person's website. I would have thought even the most minor celebrity would not want the publicity of selling replica bags!0
