    Come on Anthony, you've had the very best from all the 'heavy lifters' here on MSE over the past 5 months, so how about giving us the low down on your win?

    So many take from the forum regulars, who give huge amounts of their personal time and expertise for no cost, and yet give nothing back - surely you don't want to be classed in that category?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    How I beat UKPC for mulitple parking "invoices".

    I arrived in court and completed the normal procedure of signing in etc. The lady on the desk asked me if I would like to meet the UKPC representative which I declined.

    We were summoned to the hearing and the Judge sat us both down and started by asking the "UKPC representative" where is their witness, why hasn't he turned up he should be here etc. Despite the dudes effort to explain why THE WITNESS IS INAPPROPRIATE for the hearing (yes he said this). The Judge wasn't accepting it and moved on with the case. The judge then went on to address that she cannot see the signs and my car in the evidence together (as in my car under the sign from UKPC) how can she be sure that UKPC are telling the truth especially with their history ( from this moment I knew she was on my side and I had possibly won). She continued to go on about the signage and its unacceptable. In their defence, the pics they provided was really poor and unclear and the fact the sign they provided wasn't an actual photograph evidence of the sign on the site. She then asked for the contract which wasn't an actual contract it was a Contract Schedule which she wasn't accepting. I did attempt to challenge that the claimant should of included that in his defence beforehand and the bargepole argument regarding the contract and trespassing issue but she wasn't having that either( she was quite strict). She had a go at me for refusing to speak the representative before the case because I should of had a look at the contract before the hearing, which I couldn't understand how I had done wrong for not wanting to meet him and the contract should of been included into the defence. The judge then said she didn't need to hear anything from my side of the defence and told the UKPC representative that his case against me is insufficient due to the lack of proof of the signage and my car being on site and the fact that I had said I wasn't the driver at the time there wasn't any proof that I've parked on the site. Also not having a witness so therefore she dismissed the claim.

    After the case the representative said I was lucky because he feels the judge was on my side and probably has issues with UKPC already. I laughed and smile and done my victory walk away from him!

    Wonderful! Well done, so pleased to here although she was strict, she seemed to be anti-UKPC.

    Can you tell us the Judge's name please, date and which County Court and your 'claim number' so we can quote it in future in defences?

    I would love to know which lady Judge this is and where and so would lots of others! It may help other people local to you, to know this.

    Thank you, you were so much help in all of this. I didn't get her name actually but I'll look through the letters to see if it is there.

    I did try to drop a hint to be paid for turning up to court, taking up my time from work and winning from the claimant but she wasn't getting the hints lol.

    I may have done, but I know it might sound silly I had so much in there I can't remember on the top of my head. However I feel she was already aware of this from her body language....The rep for UKPC was even trying to tell her that it was unnecessary have nothing to do with my case.

    Thanks Anthony - UKPC's tarnished reputation seems well worth repeating in future court cases. They may not then feel so bold to supplicate themselves before a wised-up Judge if this is thrown into the mx at every opportunity!
