Be careful of UKPC trying to ring you before and tell you that there is no need to turn up (lies) or, on the day, ambush you outside in the waiting area, either telling you that you have no case/pushing you to settle it for a huge sum, or trying to hand you more evidence you haven't seen before. Do NOT take any papers and read this to understand what might happen, how cases can be won, and what your 'sealed bundle' is:

...as Marktheshark says there, a 'sealed bundle' is when ''evidence is sealed by the colour red, it can be a red bag, a red string tie, a red ribbon, red signifies sealed. An untied unsealed bundle of documents is an invitation for evidence and a clever brief will take advantage of ignorance and drop addition documents on your unsealed bundle.''

Thank you Coupon Mad. So I must not take any papers that UKPC try to give me.

That line was really helpful. Im going to include that in my notes, hopefully that will do justice.

The letter regarding the PART 18 was received from SCS LAW. They basically told me in the letter the PART 18 does not apply to small claims hearings subject to the court making an order of its own initiative. They also say their client is under no obligation to respond to my part 18 request but will answer a few in which they have said. UKPC are the principal in making the claim, the sum claimed is a contractural sum which becoming owing upon breach and they sent me a copy of the signage installed at the site.
I just glanced back through the thread so in the absence of a court report would speculate that UKPC lost on the fact that the sign is forbidding so there was no offer of parking & thus no contract & as they are not the occupier of the land they cannot sue for trespass. Failing that their lie that they are the principal offering a contract for parking will trip them up never mind the ludicrous claim that the charge is a contractual sum owing upon breach. It's either a contractual sum or damages on breach it cannot be both. In fact it's neither as it's a penalty intended to deter unauthorised parking.

I glanced back too and I also wonder if some procedural issue may have annoyed the judge, such as 'no particulars of claim' (when reviewing the thread quickly, I couldn't see they did follow the claim form with any detailed particulars?). Maybe Anthony then won on signage if the Judge was on his side.

    Or maybe UKPC didn't show?!

I think if it was a UKPC no show that the OP could have managed a one line court report by now. :)
