Fuming at jobcentre, pushing us through hoops

    It implies something untoward, why would you need two?

    Back to the thread, has your friend actually done anything about getting the evidence requested by the Jobcentre?

    Obviously but the employer took 2 months and a lot of nagging to get his P45 and it may take ages to get things sorted again as employer refused a P45 at first

    As for 2 accounts I prefer this username so use it.
  • Sorry but I agree with all the other posters I read the other thread and these questions are the same.

    At the end of the day if your friend has nothing to hide then he should just provide the information they request.
    The fact is the jobcentre have a job to do they have to make sure that money from the public purse is spent correctly which is why they have the rules about when you can claim and if your friend does not meet their criteria he will not get it simple as.
    Also with regards to his recent behaviour you can not help someone who doesnt want to be helped.

    By all means waste money on solicitors but if he cant provide what they want he will not get JSA and he will get laughed out of court.

    All this may sound harsh and I am not trying to be but if he wants them to provide him with benefits he needs to play by their rules.

    But he has provided info, by that reckoning if the jobcentre says "we need a letter from your ex boss's mother to confirm they are a real person" he should

    They want a letter to confirm what they already know.

    The P45 states final pay, his payslips show when he was paid and what amound(which = what P45 says) the payslips show date of payment, his name, national insurance number etc.

    So why does the jobcentre want this again?

    And the employer wont give this so why should my friend suffer! and me as a result of his suffering.

    The jobcentre can ask for whatever additional information they deem needed. I suggest that your friend tells the jobcentre that his ex boss is refusing to co-operate and ask them (not tell or demand) to contact his ex boss.

    Why not treat this as a little life lesson?

    The civil service is full of beaurocracy. No one likes it, including the people that work in the system, but there is absolutely nothing you can do about it.

    If you work with the system, you will have a much easier life. Try to fight against it, you'll just spend your laugh on here moaning about it!

    Lol I already knew the system was flawed, I knew that when my pill head neighbours play the system and get benefit and work full time and sublet etc.

    The system knows it cant stop the con artists so preys on the innocent weaker ones who dont fight back as they know thats only way they can recoup some of the funds lost in fraud etc.

    I believe we have worked with the system,(my friend and me pressurising him) handed in payslips about 4 times as they kept losing them, sent letters from friend confirming when he left and details, contacted the employer a lot etc.

    It's just a morale thing, he has no confidence in anything which in turns comes back and hits him as he wont put his full effort into applying for jobs as he believes theres no point as he will be rejected.

    And he has told jobcentre many times his ex employer refuses to cooperate. in fact once when he was beside me and I phoned for him I said to advisor what if his employer refuses to give him a P45 and was told "then he wont get benefits as its his responsibility to get one"

    As said before I had same problem last year but it never went this far, I signed off as I moved town for college, and ex employer never gave P45 and jobcentre were polite and said they would work it out on my payslips and 3 weeks after claim opened, I had cash.

    Its just confusing why I have no trouble and my friend does, I think its because he lost the spark within him wanting to fight and just wants to lie down and let it all go away.

    Interesting how this discussion has moved from dwp incompetance to why isnt the friend currently working. Are the dwp immune to legal action because they are a government department?

    I advise you to contact your MP, when I had dwp incompetance on my IB claim some years ago she got them moving and I recieved an apology from the manager.

    Quite simply put they are placing obstacles in the path of paying out, it happens to be conveniant to them that the ex employer is uncooperative so they can simply keep saying you need to get this else we wont pay you when all they need to do is contact the ex employer themselves or use common sense to work without th emissing information.

  • It's unfortunate, but the JCP has certain "evidence requirements" before a clim can be processed. Final Earnings from an ex employer is just one of them. Its basically to se if any holiday pay/pay in leu of notice is outstanding. This is so they know when to start paying a persons benefit and not to overpay them. The last thing your friend needs is a letter from the DWP saying that there was a payment issued when there shouldn't have been one, because that debt will be recovered. It's a horrible system because trying to get information from ex employers is like trying to get blood from a stone. If it any consolation to anyone the system will be changing in October so that wage slips/P45s will be acceptable enough, no more running after the employers!

    What is confusing is he was only there for 2 weeks, so how could he get holiday pay! and if the empluyer wrote a P45 stating total pay £58 and this P45 was issued only last week, and its over 2 months since he left, why are they saying he could of got holiday pay when that would be on the P45! plus the silly advisors claim he could of worked longer than he claims.

    Silly system whats the point of demanding a P45 if they dont use it!
