Others (and certainly most commercial contract disputes) will have little to no Acts involved and the determination is around whether the contract have been met with no breach of the 'law' being argued.

    The English law system is varied and complex, particularly around contracts and especially when 'consumers' are involved. It's been some time since my undergraduate days and my memory is somewhat foggy but there is a significant difference between other European codes where (I think) breaching a contract is seen more like breaching the law, and the English legal system where it is certainly not.

    I think perhaps you're trying to be too much of a stickler on what breach of law means while at the same time taking a very liberal and loose definition of what a hearing is.

    Your earlier point about them having to put forth a defence - their defence would be that there is no case to answer, that they are not the liable party. Depending on what you say on your claim form (and depending how experienced the judge is with that type of law) then the judge might order a preliminary hearing to establish whether there is a case or answer or not. There are many points at which a claim can be dismissed, the initial defence is just one of them. I really don't think anyone was saying that its guaranteed to be dismissed at the first stage - just that your claim is so weak, its likely to fall at the first hurdle.

    To be quite honest, a judge dismissing it at the first stage would be in your favour - as then you'd escape paying only the filing fee as opposed to the additional costs you'd incur if it did go on to a hearing.

  • So long story short, I have an affected model. and It has caught fire !! it no longer heats up .. assuming it has tripped out and it also makes a god awful noise when spinning.


    I have registered the model also I have requested an engineer. no one has got back to me twice and I have had the phone put down on me !! Ill call again today .. but I wont hold my breath.
    anyone else experiencing same problem ? any advice ??

    It "caught fire" and you're still trying to use it? :eek:

    What have you said to/asked of Hotpoint so far?

    For the benefit of others, please could you provide more detail i.e. what model is it and when you say 'caught fire' what actually happened - smoke, flames, fire brigade attendance etc...?
  • Finally had an engineer out to my dryer last week (19th Feb) after registering in November and a lot of pestering on Facebook and Twitter. the modification is basically putting a new back on the machine which is supposed to seal everything in in according to the guy. Also got a new belt out of it! He admitted that they are far too busy and cannot keep up - he has been fixing them since March last year?? I would suggest to people who aren't getting anywhere over the phone to just persevere on social networks.
  • Hello - I'd appreciate some advice please from the collective wisdom of MSE forums.

    We had one of the faulty models, registered for a repair as everyone else did - last weekend got an email offering us a new one for £59, or a repair in August. I was very happy to pay £59 for what looked like a better model, payment made directly to Hotpoint, and delivery arranged for today.

    Today they came and took the old one away, installed the new one and off they went. My husband put some washing on, and then moved it to the new tumble dryer - within minutes of turning it on there was a smell of burning oil and plastic, and smoke started pouring out the underside! Thankfully he was on top of it to turn it off at the socket - on pulling it out from under the worktop he found the back was way too hot to be safe.

    Then he spent the rest of the day trying to get someone to sort it out. Finally got contact numbers from the Hotpoint FB page, 2 separate calls and promises of a call back but we're not holding our breath.

    Our hopes of getting this resolved are almost non-existent - any suggestions?

    Avoid the phones, letter seems to be the best way to go.

    Draft out a complaint letter and send it to them 1st class, may seem like a "slow" option but a few people on here have said they've been contacted next day.

    Phones are simply a no go IMO, far too many people ringing them demanding repair dates, queue jumpers, serial complainers chugging up the lines etc... When you do get through the call centre staff are that sick of their lives (and I certainly don't blame them!) they don't even care anymore.
  • have accepted a replacement for my dodgy dryer. Didn't want to wait until Sept, which was earliest date to have mine fixed. Cost me £99 but what price life?
  • Modification as just been completed and took 78 mins engineer fitted also a new door lock, very satisfactory job, he gives instruction filter to be cleaned each use and condenser to be cleaned monthly.


    I never heard back from Hotpoint on my request to purchase a 7 kg condenser dryer in place of the 8 kg offered in spite of 5 or 6 acknowledgements saying my requests passed to the relevant department.
    So will see how long my 9 years old dryer lasts and leave the £99 in the bank a while longer.

    Hi Guys sorry, should of been more specific..


    moved the dryer to find soot on the floor.
    put on to test and smoke came out stopped using machine !
    called twice got hung up on once
    finally today someone has called from head office to confirm engineer date. I think I'm going to need a new unit as mine is pretty much toast.
    I'm guessing I will have to talk to the engineer if the unit is retrievable or not. I hope it doesn't cost me money.
