I got respond from ALDI shop that they can not help me with this fine they do not own a land and I need to contact UKPC directly. :-(0 -

Dear Mr XXX,
Thank you for your recent correspondence in relation to the above Parking Charge.
In order to make a final decision regarding your appeal, please can you provide a copy of the drivers full details so
we can liaise with them directly to our Appeals Department within 21 days of the date of this letter.
Paragraph 9(2)(b) of schedule 4 of the Protection of Freedoms Act 2012, states that we must inform the registered
keeper that the driver of a vehicle is required to pay the parking charge in full. It also notes that as we do not know
the driver’s name or current postal address, the registered keeper, if they were not the driver at the time, should
inform the operator (i.e. us) of the name and current address of the driver and pass the notice to them.
The Act also warns that if, at the end of the period of 28 days (beginning with the day after the Parking Charge is
sent), the parking charge has not been paid in full and the operator does not know both the name and current
address of the driver, the operator has the right to recover any unpaid part of the parking charge from the
registered keeper. This warning is given under Paragraph 9(2)(f) of Schedule 4 of the Protection of Freedoms Act
2012 and is subject to us complying with the applicable conditions under Schedule 4 of that Act (which we consider
we do comply with, to the letter).
The highest court in the UK, the Supreme Court, has unambiguously confirmed that parking charges issued on
private land are fully enforceable. In the case of ParkingEye v Beavis [2015] UKSC 67 their Lordships stated that
private parking charges were enforceable because they served a legitimate interest and were in the interests of the
public generally. The case confirmed that the amount of the charge does not have to reflect any loss that might
have been caused by breach of the terms and conditions of parking.
The Supreme Court decision is binding law on all other courts throughout the UK.
Failure to provide this information will give us no alternative other than to make our final decision based on the
previous information received, at this stage a POPLA verification code will be provided.

What happen if I said it was my brother driver who is not living in UK and living in Croatia?0 -
Then they would have to deal with him. However, if this did get to court you might be asked to prove that you had a brother in Croatia, so best not to tell porkies.You never know how far you can go until you go too far.0

From my reading UKPC still haven't sent you a NTK, so there is no need to reply to their letter at the moment.I belive I should not tell them who is was a driver.

Far more importantly UKPC must either accept or reject your original appeal within 35 days. If they reject it they must provide a POPLA code. Reading UKPC's reply they have done neither and the deadline for them is 19th December.0 -

The UKBC do not have so long hand to reach him there :rotfl:
And Croatia law do not recognize private parking fines...0 -

If it is true that your brother was actually driving the car on the date in question, then you should definitely give UKPC that information.
If he was not driving the car, then you should not mention it.I married my cousin. I had to...I don't have a sister.

I got same letter again from my previous post. They did not provide any NTK or POPLA code.

They are deperate to know who was driving. IGNORE THAT LETTER. Patience - forget the deadline, they'll get there.
A rejection always follows in the end, with a POPLA code. Then if you follow the script and write a decent long POPLA appeal like the examples in the NEWBIES thread post #3, and rebut any evidence pack well, you will win as long as the driver is not divulged and you show POPLA some decent appeal points, as per loads of other threads here already.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
